REPORT PURPOSE<br />

The purpose <strong>of</strong> this report is to seek Council approval for an additional option right in<br />

regards to the Helicopters New Zealand Pty Ltd proposed lease <strong>of</strong> Lot 31 at Karratha<br />

Airport.<br />

Background<br />

Council, at the meeting held on 15 December 2008, considered the tender received by<br />

Helicopters New Zealand Pty Ltd (RFT KAP04-08/09) Item 9.2.2. Council subsequently<br />

approved the tender as per the below:<br />

Res No : 14541<br />

That Council resolve to award tender Karratha Airport Lease <strong>of</strong> Land – Lot 31<br />

KAP04-08/09 to Helicopters NZ Pty Ltd and approves the entering into a lease<br />

arrangement, for a term <strong>of</strong> 25 years, for the amount <strong>of</strong> $49,000 p.a. (excluding GST).<br />

Issues<br />

Correspondence has subsequently been received from Helicopters NZ seeking an<br />

additional option term <strong>of</strong> 17 years in regards to the proposed lease.<br />

If Helicopters NZ sought this option after the expiry <strong>of</strong> the initial 25 year term, then as per<br />

the lease arrangements it will be their responsibility to apply in writing not more than 6<br />

months or less than 3 months before the expiration <strong>of</strong> the term, advising <strong>of</strong> their intention to<br />

exercise the option. Provided there has been no breach during the initial term <strong>of</strong> the lease<br />

arrangements; then the Lessor (<strong>Shire</strong>) would be required to exercise the lease option.<br />

Options<br />

Council now has the option <strong>of</strong> approving the lease with the addition <strong>of</strong> an option term <strong>of</strong> a<br />

further 17 years.<br />

Policy Implications<br />

There are no relevant policy implications pertaining to this matter.<br />
