Conclusion<br />
Final adoption <strong>of</strong> the Scheme amendment is recommended as no objections to the<br />
proposal have been received and the intended use is critical to RTIO‟s future operations at<br />
Cape Lambert. The waste material proposed to be deposited as landfill is generally inert<br />
and any potential environmental impacts will be controlled under a licence to be issued by<br />
the DEC. The licence would ensure that the operator <strong>of</strong> the facility is responsible for strict<br />
environmental compliance including monitoring and management. At the end <strong>of</strong> the<br />
lifespan <strong>of</strong> the landfill site, Council has the option to remove the additional use<br />
classification for the land from the Scheme.<br />

RECOMMENDATION<br />
That Council resolves to acknowledge the submissions received from the<br />
Department <strong>of</strong> Water, the Water Corporation, the Department <strong>of</strong> Indigenous Affairs<br />
and the Department for Planning and Infrastructure, State Land Services and finally<br />
adopt the TPS8 Amendment No. 14 to add the 20.09ha portion <strong>of</strong> unallocated Crown<br />
land (UCL) adjacent the Cape Lambert railway (Crown Lease I123393) to TPS8<br />
Appendix No. 6 Additional Use Table with the nominated additional use being<br />
„Industry-Noxious‟ and to forward the amendment to the WAPC for report to the<br />
Minister for Planning.<br />
