Food Act ministerial directions<br />

In accordance with Section 7E of the Food Act 1984,<br />

<strong>Council</strong> is required to publish a summary of any<br />

Ministerial Directions received during the financial year.<br />

No such Ministerial Directions were received by <strong>Council</strong><br />

during the <strong>2017</strong>–<strong>18</strong> financial year.<br />

Freedom of Information (FOI) report<br />

In accordance with the Freedom of Information Act 1982<br />

reporting requirements, the following information is<br />

supplied for the period 1 July 2016 to 30 June <strong>2017</strong>:<br />

a. twenty five (25) FOI requests were made to <strong>Cardinia</strong><br />

<strong>Shire</strong> <strong>Council</strong><br />

b. twenty five (25) requests were made for full access to<br />

documents for the above period; no requests for part<br />

access to documents pursuant were made and no<br />

requests were pending as at 30 June 20<strong>18</strong><br />

c. Manager Governance Doug Evans is the designated<br />

officer with authority to make a decision in relation to<br />

a request<br />

d. 1 application for review was made to the Freedom of<br />

Information Commissioner<br />

e. no application was made to the Victorian Civil and<br />

Administrative Tribunal (VCAT) during the above period<br />

f. no notices were served on the agency under<br />

Section 12 (1)<br />

g. no disciplinary action was taken out against any<br />

officer in respect of the administration of this Act<br />

h. no charges were levied on the applicants.<br />

Protected disclosure procedures<br />

The Protected Disclosure Act 2012 aims to ensure<br />

openness and accountability in government by<br />

encouraging people to disclose improper conduct within<br />

the public sector and provide protection for people<br />

who make disclosures. Procedures on how to make a<br />

disclosure are publicly available on <strong>Council</strong>’s website.<br />

During <strong>2017</strong>–<strong>18</strong>, no disclosures were notified to<br />

<strong>Council</strong> officers appointed to receive disclosures or to<br />

the Independent Broad-based Anti-corruption<br />

Commission (IBAC).<br />

Road Management Act ministerial<br />

direction<br />

In accordance with Section 22 of the Road Management<br />

Act 2004, <strong>Council</strong> is required to publish a copy or a<br />

summary of any Ministerial Directions received during<br />

the financial year. No such Ministerial Directions were<br />

received by <strong>Council</strong> during the <strong>2017</strong>–<strong>18</strong> financial year.<br />

National Competition Policy compliance<br />

<strong>Cardinia</strong> <strong>Shire</strong> <strong>Council</strong> has complied with the<br />

requirements of the National Competition Policy for the<br />

period 1 July <strong>2017</strong> to 30 June 20<strong>18</strong>.<br />

Current Local Laws<br />

As at 30 June 20<strong>18</strong>, <strong>Council</strong> had two principal Local Laws<br />

in operation.<br />

Local Law No 8 Meeting procedure local law<br />

This Local Law regulates proceedings at meetings of<br />

<strong>Council</strong>, Special Committees and Advisory Committees,<br />

and regulates the use of the common seal.<br />

Local Law No 17 Environment, amenity and asset<br />

protection local law<br />

The purpose and general purport of this Local Law is to:<br />

• provide for the peace, order and good government of<br />

<strong>Cardinia</strong> <strong>Shire</strong> <strong>Council</strong><br />

• promote a physical and social environment in the<br />

municipal district free from hazards to health and<br />

safety, and to prevent and suppress nuisances that<br />

may adversely affect persons<br />

• prohibit, regulate and control activities that may<br />

be dangerous or unsafe or detrimental to the<br />

quality of life, the environment and the amenity<br />

of the municipality<br />

• prohibit, regulate, and control access to, and<br />

behaviour in, municipal places, buildings, recreation<br />

centres and reserves, and to protect public assets<br />

vested in <strong>Council</strong><br />

• define the standards to which persons engaged in<br />

building work should adhere, which aims to minimise<br />

the impact of building activities in respect of hazards<br />

to health and safety, the presence and disposal of<br />

builders’ refuse, rubbish and soil, stormwater and<br />

other pollution<br />

• provide for the consistent application and<br />

enforcement of this Local Law.<br />
