11. Temporal considerations<br />

Harbour porpoises live in many parts <strong>of</strong> <strong>the</strong> Baltic Sea year-round, but have to avoid complete ice cover.<br />

Therefore, considerations could be less stringent in nor<strong>the</strong>rn parts <strong>of</strong> <strong>the</strong> Baltic Sea in winter during icecover.<br />

Bird bycatch rates are higher in winter (Oct-April) due to several bird species <strong>the</strong>n occurring in <strong>the</strong><br />

marine environment in large concentrations. Bycatch, however, does occur all year around, although it<br />

affects different species at different times <strong>of</strong> <strong>the</strong> year. Areas covered completely by ice do not hold any<br />

diving birds and hence have no bycatch in winter.<br />

12. Current monitoring<br />

In some ra<strong>the</strong>r small parts <strong>of</strong> <strong>the</strong> western Baltic Sea, porpoise monitoring is being attempted under EC<br />

Regulation 812/2004, however, with insuffi cient coverage. Fur<strong>the</strong>rmore, it is also required under <strong>the</strong><br />

Habitats Directive. There is no monitoring for bird bycatch so far.<br />

13. Proposed or perceived target setting approach with a short justifi cation.<br />

In <strong>the</strong> Baltic Proper and in <strong>the</strong> Belt Sea, porpoise bycatch needs to be close to zero to allow recovery <strong>of</strong><br />

<strong>the</strong> populations. The anthropogenic removal (including by pollution, ship strike, noise etc.) <strong>of</strong> more than<br />

one porpoise from this entire population has been modeled to thwart recovery from <strong>the</strong> brink <strong>of</strong> extinction<br />

(Berggren et al. 2002). The target <strong>of</strong> zero bycatch should be linked to a policy decision, e.g. to close<br />

<strong>the</strong> area for net-setting fi sheries for <strong>the</strong> remainder <strong>of</strong> <strong>the</strong> year as soon as more than one harbour porpoise<br />

has been caught (cf. NOAA 2010, NZ Minister <strong>of</strong> Fisheries 2006).<br />

For <strong>the</strong> vulnerable Belt Sea population, an anthropogenic removal <strong>of</strong> 1% <strong>of</strong> <strong>the</strong> total population per year<br />

in Danish, Swedish and German waters combined would not allow recovery <strong>of</strong> <strong>the</strong> population from a<br />

60% reduction between 1994 and 2005 and jeopardise its continued survival (Teilmann et al. 2011).<br />

For birds, levels <strong>of</strong> <strong>of</strong> tolerable total anthropogenic removal have been calculated for a few species based<br />

on known population sizes and demographic parameters. Such levels can be used to calculate <strong>the</strong> levels<br />

<strong>of</strong> bycatch that can be sustained by <strong>the</strong> populations (if knowing o<strong>the</strong>r sources <strong>of</strong> anthropogenic mortality<br />

as well). GES boundaries could <strong>the</strong>n be set at levels below <strong>the</strong>se to guarantee continued survival <strong>of</strong><br />

<strong>the</strong> populations.<br />
