Legislation Governing <strong>Crown</strong> <strong>L<strong>and</strong></strong><br />
Management<br />
The <strong>L<strong>and</strong></strong> Act is an important part <strong>of</strong> the legislative<br />
<strong>and</strong> regulatory framework that guides the allocation<br />
<strong>and</strong> management <strong>of</strong> <strong>Crown</strong> l<strong>and</strong> in BC. 1 The Act<br />
largely governs the acquisition, disposition,<br />
management, administration, transfer<br />
<strong>and</strong> surveying <strong>of</strong> <strong>Crown</strong> l<strong>and</strong> in BC. 2<br />
The Act is the main legislation used<br />
by the government to convey<br />
l<strong>and</strong> to the public by granting<br />
l<strong>and</strong> or by issuing <strong>Crown</strong> l<strong>and</strong><br />
tenures in the form <strong>of</strong> leases,<br />
licences, permits <strong>and</strong> rights-<strong>of</strong>way.<br />
Important decision-making<br />
powers authorized under the Act<br />
include:<br />
• Determining if a disposition<br />
<strong>of</strong> <strong>Crown</strong> l<strong>and</strong> is in the public<br />
interest;<br />
• Temporarily reserving <strong>Crown</strong> l<strong>and</strong><br />
from disposition;<br />
• Designating <strong>Crown</strong> l<strong>and</strong> for a<br />
particular use; <strong>and</strong><br />
• Prohibiting certain uses <strong>of</strong> <strong>Crown</strong> l<strong>and</strong>.<br />
Following this introductory chapter, the remainder<br />
<strong>of</strong> the report is organized into four main parts. Each<br />
part provides an overview, followed by sections<br />
detailing key indicators <strong>and</strong> statistics. Each section<br />
begins with a brief discussion <strong>of</strong> why the indicator<br />
is important, followed by key statistics <strong>and</strong> finally<br />
a broader discussion <strong>and</strong> analysis <strong>of</strong> the data (see<br />
Figures 1 <strong>and</strong> 2 for illustrations <strong>of</strong> the report structure<br />
<strong>and</strong> reporting framework).<br />
1 The other key Acts <strong>and</strong> Regulations are summarized in the<br />
Summary <strong>of</strong> <strong>Crown</strong> <strong>L<strong>and</strong></strong> Administration Division Acts <strong>and</strong><br />
Regulations, 2008, (see Additional Information for details).<br />
2 In addition, dispositions sometimes occur under the <strong>Ministry</strong><br />
<strong>of</strong> <strong>L<strong>and</strong></strong>s, Parks <strong>and</strong> Housing Act. These dispositions are also<br />
discussed in this report (see Section 5.4, Grants by Sector).<br />
• Part 2, <strong>L<strong>and</strong></strong> <strong>and</strong> Resources: presents an<br />
inventory <strong>of</strong> BC’s l<strong>and</strong> base including <strong>Crown</strong><br />
l<strong>and</strong>. The l<strong>and</strong> base is analyzed by indicators<br />
such as ownership type, l<strong>and</strong> cover, resources,<br />
<strong>and</strong> l<strong>and</strong> use activities.<br />
