Discussion<br />

Although the original intent <strong>of</strong> the 1999 <strong>L<strong>and</strong></strong>scape Unit<br />

Planning Guide was to create legally established OGMAs<br />

throughout the province, several factors have resulted in<br />

a mix <strong>of</strong> legal <strong>and</strong> non-legal OGMAs. Plan areas that do<br />

not have any spatial OGMAs identified (or regional nonspatial<br />

orders) are covered by the Provincial Non-Spatial<br />

Old Growth Order.<br />

Work is underway in the province to legalize some <strong>of</strong> the<br />

OGMAs that are currently non-legal. It is anticipated that<br />

the Fort St. John <strong>and</strong> Mackenzie LRMP areas may have<br />

legally established OGMAs in place by 2012.<br />

Legally established OGMAs provide protection for critical<br />

old growth habitat. Where no legally established OGMAs<br />

exist, licensees can establish their own OGMAs, as long<br />

as they comply with the Provincial Non-Spatial Old<br />

Growth Order, or other regional orders that supersede<br />

the provincial order. In many cases, non-legal OGMAs are<br />

created collaboratively between licensees <strong>and</strong> government,<br />

<strong>and</strong> are included in Forest Stewardship Plans. 59<br />

Presently, legally established OGMAs are only applicable to<br />

forestry activities regulated under FRPA. However, Sections<br />

103 <strong>and</strong> 104 <strong>of</strong> the newly passed Oil <strong>and</strong> Gas Activities Act<br />

provide authority for government to establish OGMAs for<br />

the purposes <strong>of</strong> oil <strong>and</strong> gas activities.<br />

such as a beetle infestation or wildfire, establishing a legal reserve<br />

at the l<strong>and</strong>scape scale may not serve their intended purpose over<br />

time. Planners <strong>and</strong> practitioners may choose instead to establish<br />

a non-area-specific old growth retention strategy to manage for<br />

biodiversity.<br />
