remaing upon Record in the Secretary's office may appear.<br />

And whereas Alexander Frazier Chyrurgeon and Sarah his<br />

Wife and Relict and adminstratrix of the said Thomas Stirling<br />

deceased have by their humble petition to this present General]<br />

Assembly sett forth that the said Thomas Stirling in his Life<br />

time after the makeing the mortgage aforesaid did designe<br />

and intend to devise other Lands of his to be sold for Redemption<br />

of the said Mortgaged premises but before such bequest<br />

made dyed suddenly and administration of all his Goods<br />

and Chattells rights and Creditts was Committed to the said<br />

Sarah whilst sole which personall Estate was not sufficient to<br />

pay the Debts of the said Thomas Stirling over and beside the<br />

said Mortgage and that the said Mortgage was made without<br />

the privity or Consent of the said Sarah and the said Thomas<br />

Stirling leaving behinde him a Considerable reall Estate and<br />

but only one Child or Daughter Called Christian his only heir<br />

and now a minor and that the Land so as aforesaid Mortgaged<br />

was the mantion or Dwelling plantation of the said Thomas<br />

Stirling and with the improvements of farr Greater Vallue than<br />

the sume for which it was mortgaged but before the same<br />

Could be Redeemed by the said Christian who is of tender<br />

years the interest thereof would wholly Eat up and Consume<br />

the said mortgaged premises and therefore humbly supplicated<br />

this present General! Assembly that some persons might be P' 344<br />

appointed Trustees on behalfe of the said Orphan and Impovvred<br />

by act of this Generall Assembly to sell and dispose<br />

of the Lands by the said Thomas Stirling designed to be devised<br />

to be sold for Redemption of the said Mortgaged Premises<br />

which being by this Generall Assembly thought Reasonable<br />

Be it Enacted by the Queens most Excellent majesty by and<br />

with the advice and Consent of her Majestys Governour<br />

Councill and Assembly of this province and the Authority of<br />

the same that the honourable William Holland Esq' one of<br />

her Majestys Honourable Councill of Maryland Charles Carroll<br />

of the Citty of Annapolis Esq' John Mackalland Richard Dallam<br />

of Calvert County Gentlemen or any three of them shall be<br />

and are by Vertue of this Act Constituted and appointed<br />

Trustees to act to and for the Vse and beneffittandon behalfe<br />

of the said Christian Stirling the Daughter of the said Thomas<br />

Stirling And shall be and are hereby authorised and Impowred<br />

bythemselvesortogeatherwith the saidSarah tosell and dispose<br />

of to the best purchasor or purchasors or him her or them that<br />

will give most for the same The Severall Lands or plantations following<br />

(that is to say) one thousand acres of Land lying in Balte-
