Lib. L. L. Assembly of this province and the authority of the same that<br />

No. 64 from and after the End of this present Session of Assembly<br />

all persons whatsoever resideing negotiating or tradeing to<br />

or within this province haveing any person all Claime or<br />

demand against any the Inhabitants of this province wherein<br />

the originall or principall debt or damage do not Exceed the<br />

Valine of twenty pounds Sterling or five thousand pounds of<br />

tobacco shall by Virtue of this Act be obliged to sue and Implead<br />

their Severall and respective Debtors in the severall and<br />

Respective County Courts where such their Debtors do<br />

Inhabitt and Reside and not Elsewhere on Penalty of Suffering<br />

a non suite and paying the Defendant his Reasonable Charge<br />

to be adjudged by the Justices of any other Court wherein<br />

they shall be sued or Impleaded any Law Statute usage or<br />

Custome to the Contrary notwithstanding.<br />

And be it ffurther Enacted by the authority af*^ that where<br />

any Debt or Damage is Demanded by Vertue of any bond<br />

or wrighting obligatory the Penalty of such bond shall not<br />

although it Exceed twenty pounds in Money or five thousand<br />

pounds of Tob° Intitle any plaintiff to bring his action in any<br />

Court but the County Courts unless the real sume due in the<br />

Condition of such bond amounts to twenty pounds in money<br />

or five thousand pounds of Tobacco anything in this Act or<br />

any other statute Law Custome or Vsage to the Contrary<br />

Notwithstanding.<br />

And be it Further Enacted by the Authority advice and<br />

Consent af"* that from and after the End of this present Session<br />

of Assembly if the Drawer or Endorser of any bill of Exchange<br />

shall be sued or prosecuted in any Court of this province for<br />

any Summe of money due upon any protested bill of Exchange<br />

the attorneys prosecuteing or defending any action<br />

thereupon shall not Exact Demand receive or take any more<br />

than one Lawfull fee according to the directions of this Act<br />

for prosecuteing or defending any action upon any one protested<br />

bill notwithstanding there be two or more Endorsers<br />

and the Drawer sued and prosecuted and that it shall and<br />

may be lawfull to and for the Plaintiffs many actions to be<br />

brought on any protested bill to put into one writt two or<br />

more defendants resideing in one County if Occasion shall<br />

require and shall not pay for the same any other fee or Reward<br />

than for one writt and shall and may at his Election declare<br />

against such defendants Either Joyntly or Severally as he shall<br />

think fitt any Law Statute usage or Custome to the Contrary<br />

notwithstanding.<br />

And be it ffurther Enacted by and with the authority advice<br />

and Consent aP that from and after the End of this present<br />

Sessions of Assembly it shall and may be Lawfull to and for
