Elective and appointive <strong>of</strong>ficers are given a grace period <strong>of</strong> five (5) working days from<br />

<strong>the</strong>ir election or appointment to file application for renewal without penalty.<br />

Failure to file <strong>the</strong> application for renewal <strong>of</strong> permit within <strong>the</strong> prescribed period shall be<br />

subject to fines <strong>of</strong> Five Thousand Pesos (P5,000.00) if filed within six months after <strong>the</strong><br />

prescribed period and Ten Thousand Pesos (P10,000.00) if filed after six (6) months. Failure<br />

to renew <strong>the</strong> AEP within one (1) year after its expiration shall be a cause for its revocation or<br />

cancellation.<br />

SECTION 3. Effectivity - This Department Order shall take effect fifteen (15) days<br />

after its publication in two (2) newspapers <strong>of</strong> general circulation.<br />

WHEREAS, national roads and bridges are being unnecessarily damaged through <strong>the</strong><br />

movement over <strong>the</strong>se structures <strong>of</strong> freight trucks and trailers, whose gross weights and axle<br />

loads exceed <strong>the</strong> allowable limits;<br />

WHEREAS, in order to abate this condition, Republic Act (RA) No. 8794, entitled ìAn<br />

Act Imposing A Motor Vehicles Userís Charge On Owners Of All Types <strong>of</strong> Motor Vehicles and<br />

For O<strong>the</strong>r Purposes,î was enacted by <strong>the</strong> House <strong>of</strong> Representatives and <strong>the</strong> Senate on 06<br />

June 2000 and 11 April 2000, respectively , and was approved by <strong>the</strong> President on 27 June<br />

2000;<br />

WHEREAS, Section 7c <strong>of</strong> <strong>the</strong> Implementing Rules and Regulations (IRR) <strong>of</strong> RA No.<br />

8794 provides penalties for overloaded trucks and trailers and prohibits vehicles that exceed<br />

<strong>the</strong> allowable gross vehicle weights (GVW) and/or axle loads from proceeding on <strong>the</strong> roadway;<br />

WHEREAS, <strong>the</strong> Department <strong>of</strong> Public Works and Highways (DPWH) has installed<br />

weighbridge stations as strategic locations along national roads which can determine <strong>the</strong><br />

weights <strong>of</strong> trucks and trailers; and<br />

WHEREAS, <strong>the</strong>re is a need to provide efficient and coordinated use <strong>of</strong> <strong>the</strong> weighbridge<br />

and portable axle load weighing stations in order to implement <strong>the</strong> provisions <strong>of</strong> R.A. No.
