9.2 Such decision shall be final and executory where a penalty <strong>of</strong> suspension for not more<br />

than thirty (30) days or a fine not exceeding thirty (30) days salary is imposed.<br />

Section 10. Motion for Reconsideration<br />

9.1 A Motion for Reconsideration (MR) may be filed with <strong>the</strong> Campus Director within fifteen<br />

(15) days from receipt <strong>of</strong> <strong>the</strong> decision.<br />

9.2 Only one MR shall be entertained.<br />

9.3 The MR shall be based on any <strong>of</strong> <strong>the</strong> following grounds:<br />

9.3.1 New evidence is discovered.<br />

9.3.2 The decision is not supported by <strong>the</strong> evidence on record.<br />

9.3.3 Errors <strong>of</strong> law or irregularities have been committed prejudicial to <strong>the</strong> interest <strong>of</strong> <strong>the</strong><br />

movant.<br />

Section 11. Appeal<br />

11.1 An appeal may be filed by <strong>the</strong> respondent with <strong>the</strong> Board <strong>of</strong> Trustees, through <strong>the</strong><br />

Executive Director, within fifteen (15) days from <strong>the</strong> receipt <strong>of</strong> <strong>the</strong> decision <strong>of</strong> <strong>the</strong> Campus<br />

Director.<br />

11.2 Any appeal <strong>of</strong> <strong>the</strong> decision shall be filed in accordance with <strong>the</strong> CSC rules on<br />

administrative cases.<br />

Rule VI. Administrative Penalties<br />

Section 1. Acts <strong>of</strong> sexual harassment shall be punishable as light, less grave and grave<br />

<strong>of</strong>fenses, as follows:<br />

1.1 Light Offenses<br />

1 st <strong>of</strong>fense ñ Reprimand<br />

2 nd <strong>of</strong>fense ñ Fine or Suspension not exceeding thirty (30) days<br />

3 rd <strong>of</strong>fense ñ Dismissal<br />

1.2 Less Grave Offenses<br />

1 st <strong>of</strong>fense ñ Fine or Suspension not less than thirty (30) days and not exceeding six (6)<br />

months<br />

2 nd <strong>of</strong>fense ñ Dismissal<br />

1.3 Grave Offenses<br />

Dismissal<br />

Section 2. A respondent found guilty <strong>of</strong> two or more charges shall be imposed <strong>the</strong><br />

highest penalty corresponding to <strong>the</strong> most serious charge and <strong>the</strong> o<strong>the</strong>r charges shall be<br />

counted as aggravating circumstances.
