155, Series of 2000 to the effect that the power of the Sanggunians to process
and approve subdivision plans more especially anent development standards,
shall be in accordance to and not in conflict with those prescribed under national
laws, and that no performance bond shall be imposed by the LGU apart from that
imposed by this Board;
Wherefore, be it resolved, as it is hereby resolved that this Board reiterates its
position on the foregoing matter and for purposes of consisteny and reciprocity
adopts the said memorandum circular of the Department of Interior and Local
Government under Memorandum Circular No. 2000-155, Series of 2000 addressed
to all City/Municipal Mayors and City/Municipal Sanggunians entitled, ìClarificatory
Guidelines on the LGUsí Requirement for Subdivision/Housing Developers to Post
Performance Bonds and On the Prescription of Minimum Standards for Roads
and Subdivision Projects,î copy of which is attached as Annex A*.
