RULE I - GENERAL PROVISIONS<br />

Section 1. Title <strong>of</strong> <strong>the</strong> Rules ñ These Rules shall be known and cited as <strong>the</strong> New Rules<br />

<strong>of</strong> Procedure <strong>of</strong> <strong>the</strong> Presidential Anti-Graft Commission (PAGC).<br />

Section 2. Basis and Construction ñ These Rules promulgated pursuant to Section 17<br />

<strong>of</strong> Executive Order No. 12, dated April 16, 2001, shall be liberally construed in order to carry<br />

out its objective <strong>of</strong> promoting accountability <strong>of</strong> public <strong>of</strong>ficers under Section 1 <strong>of</strong> Article XI <strong>of</strong><br />

<strong>the</strong> Constitution.<br />

The Commission shall use every and all reasonable means to ascertain <strong>the</strong> facts in<br />

each case or complaint speedily and objectively and without regard to technicalities <strong>of</strong> law or<br />

procedure, in all instances observing due process.<br />

Section 3. Jurisdiction ñ The Commission shall have <strong>the</strong> authority to investigate or<br />

hear administrative cases or complaints filed against personnel in <strong>the</strong> Executive Department<br />

<strong>of</strong> <strong>the</strong> government, namely:<br />

(a) Presidential appointees occupying <strong>the</strong> positions <strong>of</strong> assistant regional director,<br />

or an equivalent rank, and higher, o<strong>the</strong>rwise classified as Salary Grade ì26î and higher, <strong>of</strong><br />

<strong>the</strong> Compensation and Position Classification Act <strong>of</strong> 1989 (Republic Act No. 6758).<br />

(b) Also, Presidential appointees who are members <strong>of</strong> <strong>the</strong> governing board <strong>of</strong><br />

any instrumentality, regulatory agency, chartered institution and directors or <strong>of</strong>ficers appointed<br />

or nominated by <strong>the</strong> President to government-owned or controlled corporation or corporations<br />

where <strong>the</strong> government has a minority interest or who o<strong>the</strong>rwise represent <strong>the</strong> interests <strong>of</strong> <strong>the</strong><br />

government.<br />

Likewise, <strong>the</strong> Commission shall have jurisdiction to investigate a non-presidential<br />

appointee who may have acted in conspiracy or may have been involved with a presidential<br />

appointee or ranking <strong>of</strong>ficer mentioned in this section.<br />

The Commission shall have no jurisdiction over members <strong>of</strong> <strong>the</strong> Armed Forces <strong>of</strong> <strong>the</strong><br />

<strong>Philippines</strong> (AFP) and <strong>the</strong> Philippine National Police (PNP).<br />

Section 4. Governing Rules ñ Proceedings on verified complaints and on written charges<br />

filed with <strong>the</strong> Commission or those referred by disciplining authorities whose investigation is<br />

taken over by <strong>the</strong> Commission pursuant to its charter, shall be governed by <strong>the</strong> Rules on<br />

Administrative Investigations under Part I here<strong>of</strong>.<br />

Proceedings on anonymous and unsworn complaints, motu propio investigations and<br />

o<strong>the</strong>r reports shall be governed by <strong>the</strong> Rules on Fact-Finding Inquiries under Part II here<strong>of</strong>.<br />

Section 5. Investigations: Commission En Banc and Panel <strong>of</strong> Hearing Officers ñ The<br />

investigation or hearing involving presidential appointees occupying <strong>the</strong> position <strong>of</strong><br />

Undersecretary or higher shall be conducted by <strong>the</strong> Commission sitting en banc. The<br />

investigation or hearing involving presidential appointees occupying lower positions may be<br />

entrusted to a Commissioner or to a panel <strong>of</strong> hearing <strong>of</strong>ficers duly designated by <strong>the</strong> Chairman;<br />

Provided, however, that <strong>the</strong> reports or recommendations <strong>of</strong> <strong>the</strong> Commissioner or panel <strong>of</strong><br />

hearing <strong>of</strong>ficers who investigated or heard <strong>the</strong> administrative case or complaint shall be
