Spa<strong>in</strong> are the countries which <strong>in</strong>clude maritime waters, terrestrial areas <strong>and</strong> the shorel<strong>in</strong>e under the<br />
public doma<strong>in</strong>, which implies, as expla<strong>in</strong>ed below, a more complex process for aquaculture activities.<br />
The more rigorous <strong>and</strong> extensive the declaration of the public doma<strong>in</strong> <strong>in</strong> a legal framework, the more<br />
conflict will arise <strong>and</strong> more farmers will have less flexibility when it comes to licens<strong>in</strong>g. The solution<br />
for better <strong>in</strong>tegration between the public doma<strong>in</strong> <strong>and</strong> aquaculture is plann<strong>in</strong>g or zon<strong>in</strong>g.<br />
8.3.2 Authorities <strong>in</strong>volved <strong>in</strong> the licens<strong>in</strong>g procedure<br />
Several concepts used <strong>in</strong> this report have required accurate def<strong>in</strong>itions <strong>in</strong> order to ensure a common<br />
underst<strong>and</strong><strong>in</strong>g throughout countries <strong>and</strong> policy frameworks. In the licens<strong>in</strong>g process, a two-step<br />
analysis have been applied: first, for the Bodies/Departments/Authorities who directly grant the<br />
licenses, those entitled with competences <strong>in</strong> the licens<strong>in</strong>g process; second, for the authorities <strong>in</strong>volved<br />
<strong>in</strong> the licens<strong>in</strong>g process, mean<strong>in</strong>g those who should be consulted or <strong>in</strong>formed before grant<strong>in</strong>g the<br />
aquaculture license. Dur<strong>in</strong>g the surveys we made, respondents had considerable difficulties to<br />
differentiate between the two categories, what could reflect both the complexity <strong>and</strong> the lack of clarity<br />
<strong>in</strong> the aquaculture <strong>in</strong>stitutional sett<strong>in</strong>gs.<br />
