Often, these two ma<strong>in</strong> agencies belong to different departments or m<strong>in</strong>istries, which mean that they<br />

must liaise with each other <strong>in</strong> the <strong>in</strong>terest of speed<strong>in</strong>g up the proceed<strong>in</strong>gs. This makes <strong>in</strong>stitutional<br />

coord<strong>in</strong>ation <strong>and</strong> cooperation all the more necessary. For <strong>in</strong>stance, <strong>in</strong> Spa<strong>in</strong> a step forward has been<br />

the recent <strong>in</strong>tegration of responsibility for management of the coasts (public doma<strong>in</strong>) <strong>and</strong> the bodies<br />

that represent Spanish mar<strong>in</strong>e aquaculture, through the creation of the M<strong>in</strong>istry of the Environment<br />

<strong>and</strong> Rural <strong>and</strong> Mar<strong>in</strong>e Affairs. However, power to authorise aquaculture operations rema<strong>in</strong>s <strong>in</strong> the<br />

h<strong>and</strong>s of the Autonomous Communities (Regional Governments), which makes the system more<br />

complex. This analysis of the current state of play shows that the ma<strong>in</strong> problems that tend to<br />

characterise aquaculture <strong>in</strong> practically all countries relate to the lack of simplification of<br />

adm<strong>in</strong>istrative procedures, the numerous authorities <strong>in</strong>volved <strong>and</strong> the result<strong>in</strong>g over-bureaucratisation<br />

<strong>and</strong> length<strong>in</strong>ess of licence grant<strong>in</strong>g procedures.<br />

Generally, most common agencies <strong>in</strong>volved <strong>in</strong> the license grant<strong>in</strong>g process are:<br />

- Fisheries<br />

- Merchant shipp<strong>in</strong>g or navigation<br />

- Environment<br />

- Physical plann<strong>in</strong>g <strong>and</strong> public Works<br />

- Culture <strong>and</strong> heritage<br />

- National defence<br />

- Health <strong>and</strong> welfare is required<br />

- Industry<br />

- Local authorities.<br />

The survey developed with<strong>in</strong> the SHocMed project specifically addresses the ma<strong>in</strong> problems related<br />

to the licens<strong>in</strong>g procedure. The output underl<strong>in</strong>es complex, lengthy processes, multiplicity of agencies<br />

<strong>in</strong>volved <strong>and</strong> lack of zones designated for aquaculture as major hurdles.<br />

In Cyprus, problems are directly l<strong>in</strong>ked to the complicated <strong>and</strong> time-consum<strong>in</strong>g procedures, which<br />

make it difficult to react fast enough <strong>in</strong> an environment of rapid market changes. Additionally, there is<br />

a long consultation process with different authorities, each one with its proper <strong>and</strong> divergent <strong>in</strong>terest.<br />

Many of the barriers to aquaculture development are related to the lack of official aquaculture zones.<br />

Other countries such as Tunisia <strong>and</strong> Greece consider, as ma<strong>in</strong> problems, the numerous authorities that<br />

are currently <strong>in</strong>volved <strong>in</strong> the process of licens<strong>in</strong>g. In a similar way, aquaculture promoters <strong>in</strong> Turkey<br />

affirm that obta<strong>in</strong><strong>in</strong>g an aquaculture license is “too complex”.<br />

In the case of Spa<strong>in</strong>, competency to issue a license for aquaculture falls under regional governments<br />

(as <strong>in</strong> Italy), with a variety of legal frameworks that also conflict with overarch<strong>in</strong>g policies at national<br />

level (for <strong>in</strong>stance, environmental <strong>and</strong> coastal policies). The aquaculture sector also claims that legal<br />

uncerta<strong>in</strong>ty <strong>and</strong> complexity are directly translated to stagnation of aquaculture development.<br />

Montenegro represents an example of a problem-solv<strong>in</strong>g approach. If the major ongo<strong>in</strong>g problem<br />

relates to the complex <strong>and</strong> long last<strong>in</strong>g procedures for issu<strong>in</strong>g an aquaculture permit, they hope to<br />

overcome this by procedures that will be implemented under a new law (the law on mar<strong>in</strong>e fishery<br />

<strong>and</strong> mariculture which is <strong>in</strong> the mak<strong>in</strong>g 25 ).<br />

In Albania, there is a remarkable difference, as <strong>in</strong> many countries, <strong>in</strong> the ease of grant<strong>in</strong>g a license,<br />

depend<strong>in</strong>g on whether the location of the aquaculture facilities is <strong>in</strong> a public or private area. In the<br />

public zones, applicants should present complex documentation, <strong>and</strong> the adm<strong>in</strong>istrative body will go<br />
