Box 3 - Licence procedure for mar<strong>in</strong>e aquaculture <strong>in</strong> Croatia (2009)<br />
In Croatia there are four authorities/adm<strong>in</strong>istrations <strong>in</strong>volved <strong>in</strong> the aquaculture license procedure: M<strong>in</strong>istry of<br />
Agriculture, Fisheries <strong>and</strong> Rural Development (License for fish farm<strong>in</strong>g), M<strong>in</strong>istry of Environmental Protection,<br />
Physical Plann<strong>in</strong>g <strong>and</strong> Construction (EIA), M<strong>in</strong>istry of Sea, Transport <strong>and</strong> Infrastructure (concession), County<br />
(concession), Government (concession). The process starts with an aquaculture promoter submitt<strong>in</strong>g a request<br />
for concession of maritime area to the County. The County checks if area <strong>and</strong> usage stated <strong>in</strong> the request is <strong>in</strong><br />
l<strong>in</strong>e with physical plans (site <strong>selection</strong> criteria are def<strong>in</strong>ed by law); if so, county starts procedure for Location<br />
permit.<br />
The requirements for Location permit are therefore a concept design <strong>in</strong> l<strong>in</strong>e with the physical plan, EIA (if<br />
requested) <strong>and</strong> an agreement with M<strong>in</strong>istry of Sea, Transport <strong>and</strong> Infrastructure <strong>and</strong> M<strong>in</strong>istry of Agricultural,<br />
Fisheries <strong>and</strong> Rural Development.<br />
The process <strong>in</strong>cludes a public hear<strong>in</strong>g for both physical plans <strong>and</strong> EIA (if requested). After that, the County<br />
announces public tender for the award of concessions, requir<strong>in</strong>g the consent with M<strong>in</strong>istry of Agriculture,<br />
Fisheries <strong>and</strong> Rural Development. The best applicant signs a Contract on concession with the County, which<br />
gives a concession for a period up to a maximum of 20 years.<br />
F<strong>in</strong>ally, the M<strong>in</strong>istry of Agriculture, Fisheries <strong>and</strong> Rural Development issues a License for fish farm<strong>in</strong>g. The<br />
Duration of this license is related to the duration of the concession.<br />

Box 4 - Aquaculture licens<strong>in</strong>g <strong>in</strong> Spa<strong>in</strong> (2009)<br />
In Spa<strong>in</strong>, mar<strong>in</strong>e aquaculture needs a number of licences from different adm<strong>in</strong>istrations. Autonomous<br />
Communities or the regional government issues the ma<strong>in</strong> authorisation or concession <strong>and</strong> gives the right to<br />
develop the aquaculture activity. But the aquaculture promoter needs other types of licences depend<strong>in</strong>g on the<br />
site where aquaculture will be developed. In the case of mar<strong>in</strong>e aquaculture, as the maritime zones are<br />
considered public doma<strong>in</strong> or state owned property, the promoter needs a concession to <strong>in</strong>stall the facilities <strong>in</strong> the<br />
public doma<strong>in</strong>. And this concession is issued by the Central Government (adm<strong>in</strong>istration <strong>in</strong> charge of coastal<br />
protection: the M<strong>in</strong>istry of Environment, accord<strong>in</strong>g to the Law of Coast of 1988). Or even a third adm<strong>in</strong>istration<br />
could be <strong>in</strong>volved if the aquaculture facility is go<strong>in</strong>g to be <strong>in</strong>stalled <strong>in</strong> harbour areas, also considered a public<br />
doma<strong>in</strong> accord<strong>in</strong>g to the Harbour Law (27/1992).<br />
So, when the aquaculture facility needs an area <strong>in</strong> the public doma<strong>in</strong>, owned by State, the grant<strong>in</strong>g procedure<br />
becomes more complex <strong>and</strong> requires considerable coord<strong>in</strong>ation between authorities responsible for aquaculture<br />
(regional government) <strong>and</strong> authorities responsible for manag<strong>in</strong>g coastal areas, mar<strong>in</strong>e zones, etc. This double<br />
concession <strong>in</strong>volves a complex <strong>and</strong> time-consum<strong>in</strong>g procedure that <strong>in</strong> Spa<strong>in</strong> takes 18 to 24 months for coastal<br />
doma<strong>in</strong> public use <strong>and</strong> 8 months for harbour doma<strong>in</strong> public uses.<br />
Many regional governments tried to reduce the procedures <strong>and</strong> improve their efficiency by design<strong>in</strong>g coastal<br />
zone plann<strong>in</strong>g for aquaculture. With plann<strong>in</strong>g as a tool for manag<strong>in</strong>g aquaculture, the adm<strong>in</strong>istration def<strong>in</strong>es <strong>and</strong><br />
sets up maritime <strong>and</strong> coastal zones designated for aquaculture activities. In the last decade, some of these<br />
regional governments started to def<strong>in</strong>e these “<strong>in</strong>terested zones for aquaculture” described by Law 23/1985, as<br />
“those zones that for its optimum conditions for aquaculture needs official protection”. The European<br />
Commission is also worried about the space limitations for aquaculture <strong>and</strong> strongly recommends the<br />
importance of technological developments <strong>and</strong> spatial plann<strong>in</strong>g through this useful management tool.<br />
Besides the public bodies <strong>in</strong>volved <strong>in</strong> the procedure, the concurrence of two ma<strong>in</strong> adm<strong>in</strong>istrative<br />
authorities is required: one is responsible for the actual activity of aquaculture <strong>and</strong> grants the licence<br />
to beg<strong>in</strong> operations, <strong>and</strong> another that manages the public owned shorel<strong>in</strong>e <strong>and</strong> public coastal areas,<br />
<strong>and</strong> authorises the occupation of a public area for a specified time. It is the grant<strong>in</strong>g of this second<br />
authorisation that generates most problems.<br />
