Based on the results of the surveys <strong>and</strong> analysis of the legal frameworks for aquaculture, the ma<strong>in</strong><br />
outputs of this report are the follow<strong>in</strong>g recommendations:<br />
1. Research <strong>and</strong> the results of the SHocMed surveys show heterogeneity <strong>in</strong> the legal frameworks<br />
regulat<strong>in</strong>g aquaculture, <strong>in</strong> particular: concepts, def<strong>in</strong>itions, competence, rights, <strong>in</strong>stitutions, etc.<br />
Legislation regulat<strong>in</strong>g aquaculture must <strong>in</strong>clude a def<strong>in</strong>ition of the activity <strong>and</strong> a m<strong>in</strong>imum content.<br />
It should be noted that particular laws <strong>and</strong> policies, as well as the absence of regulations, can serve<br />
as constra<strong>in</strong>s for aquaculture development. It is deemed that legislative guidel<strong>in</strong>es for the<br />
<strong>Mediterranean</strong> should address the follow<strong>in</strong>g m<strong>in</strong>imal aspects:<br />
for implementation, monitor<strong>in</strong>g <strong>and</strong> receipt of feedback of the policy proce<br />
The potential of soft law<br />
1. Establish pr<strong>in</strong>ciples<br />
2. Provide st<strong>and</strong>ards<br />
3. Provide guidance<br />
4. Foster debate <strong>and</strong> cooperation among stakeholders<br />
At <strong>in</strong>ternational level:<br />
- Code of conduct for responsible fisheries (<strong>FAO</strong>)<br />
- Code of Conduct for European aquaculture (FEAP)<br />
- Guidel<strong>in</strong>es for the susta<strong>in</strong>able development of mar<strong>in</strong>e<br />
aquaculture (IUCN)<br />
- Aquaculture site <strong>selection</strong> <strong>and</strong> site management (IUCN)<br />
At national level:<br />
- Guidel<strong>in</strong>es for mar<strong>in</strong>e aquaculture plann<strong>in</strong>g: <strong>in</strong>tegration <strong>and</strong><br />
monitor<strong>in</strong>g (Croatia)<br />
- Guidel<strong>in</strong>es for the m<strong>in</strong>imization of waste <strong>in</strong> mar<strong>in</strong>e aquaculture<br />
(Spa<strong>in</strong>)<br />

2. As Spreij (2003) po<strong>in</strong>ts out, the development of a regulatory framework not only <strong>in</strong>cludes the<br />
adoption of legislative aquaculture texts, but also the amendment <strong>and</strong>/or enactment of related<br />
laws, <strong>in</strong>clud<strong>in</strong>g l<strong>and</strong>, water <strong>and</strong> environmental legislation. For some context, it may even be<br />
sufficient to <strong>in</strong>troduce changes <strong>in</strong> the exist<strong>in</strong>g legislation without formulat<strong>in</strong>g a new aquaculture<br />
law. Additionally, criteria of flexibility should be taken <strong>in</strong>to account, s<strong>in</strong>ce legislation may<br />
quickly become outdated with the rapid evolution of the <strong>in</strong>dustry (Spreij, 2003: 11) 38 .<br />
