leave of absence, and available discretionary funds to cover retraining<br />
expenses will be made to enable faculty to qualify for reassignment.<br />
2. Preferred Consideration at Other Institutions: An individual faculty<br />
member is an employee of only one institution. Several public institutions,<br />
however, are components of a system of higher education in the state and,<br />
therefore, are mutually dependent upon the health and viability of one<br />
another. If a faculty member is to be released because of a major reduction in<br />
or discontinuance of a program, the faculty member should be given the<br />
courtesy of preferred consideration for vacancies at other institutions in the<br />
state system in accordance with system-wide policy and guidelines.<br />
3. Institutional Letter of Recommendation: A faculty member whose<br />
employment is terminated due to a major reduction in or discontinuance of a<br />
program shall be given a personal letter from the President of the <strong>University</strong><br />
which fully explains the reason(s) for termination. This letter shall expressly<br />
state that the termination does not imply a negative judgment about the<br />
person’s performance, but is due to program change.<br />
4. Assistance in Finding Employment: The <strong>University</strong> shall assist the faculty<br />
member, to the extent possible, in the sending of letters of explanation and<br />
professional resumes supportive of efforts to find suitable employment<br />
elsewhere.<br />
D. Recall of <strong>Faculty</strong> Terminated due to Reduction in or Discontinuance of an<br />
Academic Program<br />
1. If within three years following the terminated employment of a tenured or<br />
probationary faculty member due to reduction in or discontinuance of an<br />
academic program a position(s) for which the faculty member is qualified<br />
becomes vacant, the President of the <strong>University</strong> will offer the position to the<br />
affected faculty by certified mail, return receipt requested. Written acceptance<br />
of the position must be made within thirty days of the mailing of the<br />
President's offer.<br />
2. If two or more affected faculty members are qualified for a vacant position,<br />
recall will be in inverse order of termination. No new full or part-time faculty<br />
will be hired for a teaching position as long as faculty in an area of competence<br />
whose employment was terminated retain recall rights.<br />
3. A recalled faculty member shall be reinstated with the same status as held at<br />
the time of terminated employment. The salary of the reinstated faculty<br />
member shall include any general increases given to non-terminated faculty<br />
during the period of termination.
