Ireland), and requir<strong>in</strong>g the tobacco <strong>in</strong>dustry to make public<br />

all <strong>in</strong>formation about the effects <strong>of</strong> its products. All forms<br />

<strong>of</strong> tobacco advertis<strong>in</strong>g have been banned and regulations<br />

put <strong>in</strong> place to exclude <strong>in</strong>direct advertis<strong>in</strong>g. Tra<strong>in</strong><strong>in</strong>g is to be<br />

provided for <strong>health</strong> care pr<strong>of</strong>essionals and teachers.<br />

Particularly aimed at reach<strong>in</strong>g children, taxes were to be<br />

cont<strong>in</strong>uously <strong>in</strong>creased on tobacco products, the legal age<br />

for buy<strong>in</strong>g tobacco was raised to 18, and tobacco was to<br />

be sold only through registered premises. Health education<br />

programmes were to be improved and specific remedial<br />

programmes for child smokers developed.<br />

At the local level, the then regional <strong>health</strong> boards were to<br />

set up subcommittees for tobacco control and the legal<br />

provisions were to be enforced by designated environmental<br />

<strong>health</strong> <strong>of</strong>ficers and <strong>in</strong>spectors. These <strong>of</strong>ficers have the<br />

authority to issue a warn<strong>in</strong>g or <strong>in</strong>itiate proceed<strong>in</strong>gs aga<strong>in</strong>st<br />

those who contravene the law, send<strong>in</strong>g the matter to the<br />

relevant district court. The maximum f<strong>in</strong>e is a hefty €3000<br />

at the discretion <strong>of</strong> the judge. Despite the dismantl<strong>in</strong>g <strong>of</strong> the<br />

old regional <strong>health</strong> board system, environmental <strong>health</strong> <strong>of</strong>ficers<br />

and community services at the county level cont<strong>in</strong>ue<br />

much <strong>of</strong> this public <strong>health</strong> work.<br />

The OTC commissioned an <strong>in</strong>dependent scientific work<strong>in</strong>g<br />

group to <strong>in</strong>vestigate the <strong>health</strong> risks <strong>of</strong> passive smok<strong>in</strong>g. It<br />

concluded that second-hand smoke <strong>in</strong> the workplace <strong>in</strong>creased<br />

the risk <strong>of</strong> heart disease, cancer and respiratory diseases<br />

and that pregnant women, bar staff and waiters were<br />

at <strong>in</strong>creased risk. In January 2003, the M<strong>in</strong>ister announced<br />

his <strong>in</strong>tention to ban smok<strong>in</strong>g <strong>in</strong> all enclosed public places.<br />

A national debate occurred over the 15 months follow<strong>in</strong>g<br />

this announcement, with national and local media tak<strong>in</strong>g up<br />

the issue on a weekly basis (29). One <strong>of</strong> the ma<strong>in</strong> concerns<br />

was the possible loss <strong>of</strong> bar bus<strong>in</strong>ess and associated jobs,<br />

and the process was nearly derailed a number <strong>of</strong> times.<br />

Public support for the proposed measure was high, however<br />

(59% <strong>of</strong> the population one month after the announcement),<br />

support com<strong>in</strong>g from <strong>health</strong> pr<strong>of</strong>essionals, NGOs<br />

and a wide range <strong>of</strong> trade unions.<br />

The OTC and its collaborators concentrated on rais<strong>in</strong>g public<br />

awareness <strong>of</strong> the adverse effects <strong>of</strong> smoke, counteract<strong>in</strong>g<br />

mislead<strong>in</strong>g claims by opponents and build<strong>in</strong>g confidence <strong>in</strong><br />

the enforceability <strong>of</strong> the legislation. Several key steps were<br />

taken dur<strong>in</strong>g the year prior to the workplace provisions<br />

becom<strong>in</strong>g law, <strong>in</strong>clud<strong>in</strong>g: consultations with representatives<br />

<strong>of</strong> the hospitality <strong>in</strong>dustry, trade unions and enforcement<br />

agencies to develop guidance for implementation; the production<br />

and dissem<strong>in</strong>ation <strong>of</strong> <strong>in</strong>formation and guidance materials;<br />

media advertis<strong>in</strong>g on the <strong>health</strong> effects <strong>of</strong> smok<strong>in</strong>g;<br />

the sett<strong>in</strong>g up <strong>of</strong> telephone l<strong>in</strong>es to <strong>in</strong>vestigate compla<strong>in</strong>ts <strong>of</strong><br />

non-compliance; proactive visits to workplaces by environmental<br />

<strong>health</strong> <strong>of</strong>ficers before and after the <strong>in</strong>troduction <strong>of</strong><br />

the law; the establishment <strong>of</strong> f<strong>in</strong>es for non-compliance; and<br />

the prom<strong>in</strong>ent display <strong>of</strong> no-smok<strong>in</strong>g signs plus the name <strong>of</strong><br />

the person to whom compla<strong>in</strong>ts could be made. The strong<br />

focus on the plight <strong>of</strong> those work<strong>in</strong>g <strong>in</strong> bars and clubs struck<br />

a cord with the public, as they related to the problem <strong>of</strong><br />

passive smok<strong>in</strong>g <strong>in</strong> the workplace.<br />

Smok<strong>in</strong>g <strong>in</strong> the workplace was banned <strong>in</strong> 2004. With clear<br />

messages, close collaboration with key stakeholders (particularly<br />

the trade unions) and provisions for enforcement,<br />

compliance has rema<strong>in</strong>ed at over 90% and public support<br />

is almost universal. Some 98% <strong>of</strong> people th<strong>in</strong>k that workplaces<br />

are <strong>health</strong>ier as a result, <strong>in</strong>clud<strong>in</strong>g 94% <strong>of</strong> smokers.<br />

In the first 12 months <strong>of</strong> the workplace smok<strong>in</strong>g ban there<br />

was a drop <strong>in</strong> national smok<strong>in</strong>g levels, represent<strong>in</strong>g a 6%<br />

decrease <strong>in</strong> the number <strong>of</strong> people smok<strong>in</strong>g. An evaluation<br />

carried out on the National Smokers Quitl<strong>in</strong>e <strong>in</strong> March<br />

2005, showed that the workplace smok<strong>in</strong>g ban was a very<br />

important factor <strong>in</strong> help<strong>in</strong>g them quit the habit <strong>of</strong> smok<strong>in</strong>g.<br />
