SIGNIFICANT CHANGES TO THEFINANCIAL OR COMMERCIALSITUATIONTo the knowledge of the Company, there has beenno significant change to the Company’s financial orcommercial situation since December 31, 2009.The Company is thus surprised to be fined in considerationof a legal argument which it also considersruns counter to the work undertaken by the EuropeanCommission as regards reform of competition law inrecent years.On the basis of the decision of the Court of Appeal,the 8 million euro provision made in 2007 was reducedto 4.5 million euros in the financial statementsfor the year ended December 31, 2008 and retainedat this level in the financial statements for the yearended December 31, 2009.20.6.3. Disputes relating to operating licensesSome environmental protection associations regularlyfile contentious civil actions with a view to obtainingthe cancellation of permits or operating licensesgranted by the prefecture. The Company, in all cases,organizes its defense and files new applications foroperating licenses or permits to ensure normal supplyto its factories.Other than the disputes described above, there areno government, judicial or arbitration proceedings ofwhich the Group is aware, which are in abeyance orwith which it, or any proportionally consolidated subsidiary,is threatened, which may have or have had inthe past 12 months a material adverse effect on itsactivity, its financial situation or its earnings.
