The president, manager, majority of directors, and/oradministrators of the juridical person must be Chileannatural persons.A foreign registered private aircraft engaged in noncommercialactivities may not remain in Chile more than 30days from its date of entry into Chile, unless authorized bythe Dirección General de Aeronáutica Civil. For greatercertainty, this measure shall not apply to specialty airservices as defined in Article 12.1 (Definitions), except forglider towing and parachute jumping.In order to work as crew members on aircraft used by aChilean aviation company, foreign aviation staff shall berequired first to obtain a Chilean license with theappropriate permits enabling them to discharge thepertinent duties.Foreign aviation personnel shall be allowed to work in thatcapacity in Chile provided that Chilean civil aviationauthorities validate the license or authorization granted by aforeign country. In the absence of an internationalagreement regulating such validation, the license orauthorization shall be granted under conditions ofreciprocity. In that case, proof shall be submitted showingthat the licenses or authorizations were issued or validatedby the pertinent authorities in the State where the aircraft isregistered, that the documents are in force, and that therequirements for issuing or validating such licenses andauthorizations meet or exceed the standards required inChile for analogous cases.Air transportation services may be provided by Chilean orforeign companies subject to the condition that, along theroutes in which they operate, foreigners grant similar rightsto Chilean aviation companies when so requested. TheJunta Aeronáutica Civil, by means of a substantiatedresolution (resolución fundada), may terminate, suspend, orlimit domestic traffic services (cabotage) or any other classof commercial aviation services carried out solely inChilean territory by foreign companies or aircraft if in theircountry of origin the right to equal treatment for Chileancompanies and aircraft is denied.Foreign civil aircraft not engaging in commercial transportactivities or non-scheduled commercial air transportIII-CL-24
intending to enter Chilean territory, including its territorialwaters, to fly over Chile, and to make stop-overs for noncommercialpurposes, shall be required to notify theDirección General de Aeronáutica Civil at least twenty-fourhours in advance. Commercial traffic aircraft not operatingon a regular basis shall not be allowed to carry passengers,cargo, or mail in Chilean territory without prior authorizationby the Junta de Aeronáutica Civil.III-CL-25
