A juridical person must be constituted withprincipal domicile and real and effective seat in Chile. Itspresident, manager, and majority of the directors oradministrators must be Chilean natural persons. Inaddition, more than 50 percent of its capital must be held byChilean natural or juridical persons. For these purposes, ajuridical person with ownership participation in anotherjuridical person that owns a vessel has to comply with allthe aforementioned requisites.A joint ownership (comunidad) may register a vessel if (1)III-CL-26
the majority of the joint ownership is Chilean with domicileand residency in Chile; (2) the administrators are Chileans;and (3) the majority of the rights of the joint ownershipbelong to a Chilean natural or juridical person. For thesepurposes, a juridical person with ownership participation ina joint ownership (comunidad) that owns a vessel has tocomply with all the aforementioned requisites to beconsidered Chilean.Special vessels owned by foreign natural or juridicalpersons domiciled in Chile may under certain conditions beregistered in the country. For these purposes, a specialvessel does not include a fishing vessel. Foreign natural orjuridical persons must meet the following conditions: (1)domicile in Chile; (2) principal head office in the country; or(3) undertaking a profession or commercial activity in apermanent way in Chile. The maritime authority may, forreasons of national security, impose certain specialrestrictions on the operation of these vessels.The maritime authority may provide better treatment basedon the principle of reciprocity.Foreign vessels shall be required to use pilotage,anchoring, and harbor pilotage services when the maritimeauthorities so require it. In tugging activities or othermanoeuvres performed in Chilean ports, only tugboatsflying the Chilean flag shall be used.Captains shall be required to be Chilean nationals and to beacknowledged as such by the pertinent authorities. Officerson Chilean vessels must be Chilean natural personsregistered in the Officers’ Registry (Registro de oficiales).Crewmembers of a Chilean vessel must be Chilean, havethe permit granted by the Maritime Authority, and beregistered in the respective Registry. Professional titles andlicenses granted by a foreign country shall be consideredvalid for the discharge of officers' duties on national vesselspursuant to a substantiated resolution (resolución fundada)issued by the Director.Ship captains (patrón de nave) shall be Chilean nationals.The ship captain is the natural person who, pursuant to thecorresponding title awarded by the Director, is empoweredto exercise command on smaller vessels and on certainspecial larger vessels.III-CL-27
