<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010Many organizers choose to circumvent <strong>the</strong>se restrictive regulati<strong>on</strong>s and operate withoutregistrati<strong>on</strong> with <strong>the</strong> MCA, opt<strong>in</strong>g <strong>in</strong>stead to register<strong>in</strong>g as a for-pr<strong>of</strong>it organizati<strong>on</strong> with<strong>the</strong> State Adm<strong>in</strong>istrati<strong>on</strong> for Industry and Commerce (SAIC). However, suchorganizati<strong>on</strong>s (as well as organizati<strong>on</strong>s which simply do not register at all) are underc<strong>on</strong>stant risk <strong>of</strong> be<strong>in</strong>g labeled “illegal,” at which po<strong>in</strong>t a number <strong>of</strong> law enforcementmeasures may be employed to close <strong>the</strong>m down. SAIC-registered organizati<strong>on</strong>s that haveventured <strong>in</strong>to <strong>the</strong> fields <strong>of</strong> promot<strong>in</strong>g human rights and research<strong>in</strong>g sensitive topics areparticularly vulnerable to be<strong>in</strong>g shut down. One high-pr<strong>of</strong>ile example was that <strong>of</strong>G<strong>on</strong>gmeng, an NGO registered with SAIC which had been actively <strong>in</strong>volved <strong>in</strong><strong>in</strong>vestigat<strong>in</strong>g sensitive cases, such as <strong>the</strong> ta<strong>in</strong>ted milk scandal, and <strong>in</strong> assist<strong>in</strong>g petiti<strong>on</strong>ers,particularly those deta<strong>in</strong>ed <strong>in</strong> black jails.• On July 14, G<strong>on</strong>gmeng received notificati<strong>on</strong>s from both <strong>the</strong> State Adm<strong>in</strong>istrati<strong>on</strong><strong>of</strong> Taxati<strong>on</strong> and <strong>the</strong> local Bureau <strong>of</strong> Taxati<strong>on</strong> <strong>in</strong> Beij<strong>in</strong>g that <strong>the</strong>y had been f<strong>in</strong>ed1.42 milli<strong>on</strong> RMB for “tax evasi<strong>on</strong>.” Three days later, <strong>the</strong> Beij<strong>in</strong>g MunicipalBureau <strong>of</strong> Civil Affairs declared <strong>the</strong> organizati<strong>on</strong> “illegal,” raided its <strong>of</strong>fice andformally shut it down. On July 21, Xu Zhiy<strong>on</strong>g ( ), G<strong>on</strong>gmeng’s director,received separate calls from <strong>the</strong> landlord <strong>of</strong> G<strong>on</strong>gmeng’s <strong>of</strong>fice space and <strong>the</strong>landlord <strong>of</strong> his home, both <strong>of</strong> whom urged him to move out as so<strong>on</strong> as possible.On July 29, Beij<strong>in</strong>g police took Xu and Zhuang Lu ( a staff member, <strong>in</strong>tocustody. While <strong>the</strong> two were deta<strong>in</strong>ed, G<strong>on</strong>gmeng’s rema<strong>in</strong><strong>in</strong>g organizers calledsupporters for d<strong>on</strong>ati<strong>on</strong>s to help pay <strong>the</strong> banned organizati<strong>on</strong>’s enormous f<strong>in</strong>e.Complicat<strong>in</strong>g <strong>the</strong> process, however, was <strong>the</strong> refusal <strong>of</strong> tax authorities to issue <strong>the</strong>necessary paperwork, and <strong>the</strong> fact that bank accounts bel<strong>on</strong>g<strong>in</strong>g to <strong>the</strong>organizati<strong>on</strong> and director were frozen. On August 18, Xu was formally arrestedfor “tax evasi<strong>on</strong>.” 21 Fortunately, Xu Zhiy<strong>on</strong>g was released <strong>on</strong> bail <strong>on</strong> August 23,and Zhuang was also subsequently released.庄 永 志 许璐 ),G<strong>on</strong>gmeng’s treatment was not an excepti<strong>on</strong>: many more civil society organizati<strong>on</strong>s exist<strong>in</strong> this legal grey z<strong>on</strong>e and are c<strong>on</strong>stantly negotiat<strong>in</strong>g <strong>the</strong> shift<strong>in</strong>g and <strong>in</strong>visible l<strong>in</strong>e <strong>of</strong><strong>of</strong>ficial tolerance. However, G<strong>on</strong>gmeng’s case was particularly significant because <strong>the</strong>organizati<strong>on</strong> managed to operate openly for six years while be<strong>in</strong>g <strong>on</strong>e <strong>of</strong> <strong>the</strong> few to take<strong>on</strong> “sensitive” cases. The acti<strong>on</strong>s taken aga<strong>in</strong>st G<strong>on</strong>gmeng, a trailblazer <strong>in</strong> Ch<strong>in</strong>a’s civilsociety, thus raised fears am<strong>on</strong>g observers that space for activist organizati<strong>on</strong>s wasrapidly shr<strong>in</strong>k<strong>in</strong>g. The fear grew when, <strong>in</strong> August, law enforcement <strong>of</strong>ficials harassedo<strong>the</strong>r prom<strong>in</strong>ent civil society organizati<strong>on</strong>s, such as Yirenp<strong>in</strong>g, 22 an organizati<strong>on</strong> thatfocuses <strong>on</strong> <strong>the</strong> rights <strong>of</strong> hepatitis patients and o<strong>the</strong>r health-related discrim<strong>in</strong>ati<strong>on</strong> issues,Aizhix<strong>in</strong>g, 23 an HIV/AIDS organizati<strong>on</strong>, and Mr. Democracy Research Center, 24 aBeij<strong>in</strong>g legal aid organizati<strong>on</strong>. 25The closure <strong>of</strong> G<strong>on</strong>gmeng, and <strong>the</strong> harassment <strong>of</strong> Yirenp<strong>in</strong>g, Aizhix<strong>in</strong>g, and <strong>the</strong> Mr.Democracy Research Center is also a violati<strong>on</strong> <strong>of</strong> <strong>the</strong> right to solicit and receive resourcesfor <strong>the</strong> purpose <strong>of</strong> defend<strong>in</strong>g human rights. Central to <strong>the</strong> government’s case aga<strong>in</strong>stG<strong>on</strong>gmeng was its alleged failure to pay taxes <strong>on</strong> grant m<strong>on</strong>ey received from YaleUniversity, and <strong>the</strong> “tax <strong>in</strong>vestigati<strong>on</strong>s” <strong>of</strong> Yirenp<strong>in</strong>g and Aizhix<strong>in</strong>g which followed11
