<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 20102010, Gao f<strong>in</strong>ally re-appeared, giv<strong>in</strong>g ph<strong>on</strong>e <strong>in</strong>terviews to several reporters, and <strong>the</strong>n <strong>on</strong>April 7, Gao appeared for an <strong>in</strong>-pers<strong>on</strong> <strong>in</strong>terview with <strong>the</strong> Associated Press, dispell<strong>in</strong>gearlier fears that he was dead. 151 Gao refused to divulge details <strong>of</strong> his treatment dur<strong>in</strong>g hisyear-l<strong>on</strong>g disappearance, but based <strong>on</strong> past experiences, <strong>the</strong>re is good reas<strong>on</strong> to believeGao was mistreated and possibly tortured. Gao has previously been kidnapped, arbitrarilydeta<strong>in</strong>ed, and tortured <strong>on</strong> at least three previous occasi<strong>on</strong>s. 152As <strong>the</strong> experience <strong>of</strong> Gao Zhisheng dem<strong>on</strong>strates, Ch<strong>in</strong>ese police rema<strong>in</strong> will<strong>in</strong>g tobrazenly violate both <strong>the</strong> law and comm<strong>on</strong> standards <strong>of</strong> decency to <strong>in</strong>timidate or silencehuman rights defenders.b. Attacks <strong>in</strong> retributi<strong>on</strong> for rights-defense activitiesWhile it was fairly comm<strong>on</strong> for human rights defenders to be roughly handled dur<strong>in</strong>gapprehensi<strong>on</strong>s by police, and <strong>of</strong>ficials frequently used force <strong>in</strong> order to dispersedem<strong>on</strong>strati<strong>on</strong>s and group protests, it was less comm<strong>on</strong> for <strong>the</strong> authorities to violentlyattack human rights defenders <strong>in</strong> <strong>the</strong> open, rely<strong>in</strong>g <strong>in</strong>stead <strong>on</strong> o<strong>the</strong>r forms <strong>of</strong> harassmentand <strong>in</strong>timidati<strong>on</strong>.However, cases <strong>of</strong> open violence aga<strong>in</strong>st human rights defenders were documented byCHRD this past year. <strong>Human</strong> rights lawyers defend<strong>in</strong>g politically sensitive cases weretargeted <strong>in</strong> some <strong>of</strong> <strong>the</strong> most egregious attacks aga<strong>in</strong>st human rights defenders <strong>in</strong> 2009(also see p.23).Lawyers were not <strong>the</strong> <strong>on</strong>ly targets <strong>of</strong> violence <strong>in</strong> 2009. One particularly serious <strong>in</strong>cident<strong>in</strong>volved dissident Pr<strong>of</strong>essor Sun Wenguang ( ), who was attacked and beaten for<strong>the</strong> peaceful act <strong>of</strong> memorializ<strong>in</strong>g Zhao Ziyang. Sun was severely beaten <strong>on</strong> April 5 by agroup <strong>of</strong> unidentified men <strong>on</strong> his way to <strong>the</strong> local cemetery to commemorate <strong>the</strong> life <strong>of</strong>Zhao Ziyang, <strong>the</strong> late reformist CCP Secretary General known for his sympathy withdem<strong>on</strong>strators dur<strong>in</strong>g <strong>the</strong> Tiananmen Square Protests <strong>of</strong> 1989. April 5 was Q<strong>in</strong>gm<strong>in</strong>gFestival, a traditi<strong>on</strong>al Ch<strong>in</strong>ese holiday to remember and h<strong>on</strong>or <strong>the</strong> dead. A passerby whowitnessed <strong>the</strong> beat<strong>in</strong>g called an ambulance and Sun was taken to Qilu Hospital <strong>in</strong> J<strong>in</strong>anCity, where he was diagnosed with three broken ribs and <strong>in</strong>juries to his sp<strong>in</strong>e, head, back,arms and legs. Sun believes that police follow<strong>in</strong>g him witnessed <strong>the</strong> beat<strong>in</strong>g and yet didnoth<strong>in</strong>g to stop his attackers. 153广 文 孙In <strong>the</strong> cases above, as <strong>in</strong> numerous <strong>in</strong>stances <strong>of</strong> forced evicti<strong>on</strong>s or o<strong>the</strong>r cases <strong>in</strong> which<strong>of</strong>ficials (and o<strong>the</strong>rs work<strong>in</strong>g under <strong>the</strong>ir directi<strong>on</strong> or with <strong>the</strong>ir knowledge) physicallyassaulted citizens, <strong>the</strong> government failed to hold <strong>the</strong> attackers legally accountable. Thethreat <strong>of</strong> violence, <strong>the</strong>refore, rema<strong>in</strong>s real for all human rights defenders as <strong>the</strong>y go about<strong>the</strong>ir daily bus<strong>in</strong>ess.
