<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010Police appeared to deta<strong>in</strong> human rights defenders <strong>in</strong> black jails for two ma<strong>in</strong> purposes <strong>in</strong>2009: ei<strong>the</strong>r to prevent <strong>the</strong>m from speak<strong>in</strong>g out dur<strong>in</strong>g “sensitive” events, or to threatenand <strong>in</strong>timidate <strong>the</strong>m. Police used detenti<strong>on</strong> <strong>in</strong> black jails most frequently as a preventativemeasure aga<strong>in</strong>st human rights defenders with a l<strong>on</strong>g history <strong>of</strong> activism, ra<strong>the</strong>r than aspunishment for a specific acti<strong>on</strong>: for example, Xiao Changhai ( ), a Wuhan Cityrepresentative <strong>of</strong> citizens whose property was expropriated by <strong>the</strong> state <strong>in</strong> earlier periodsand are now disput<strong>in</strong>g ownership with <strong>the</strong> government, was deta<strong>in</strong>ed <strong>in</strong> a “law educati<strong>on</strong>class” between December 16, 2008, and January 18, 2009 by <strong>the</strong> Wuhan PSB. Policetold his family that Xiao was “plott<strong>in</strong>g to travel to Beij<strong>in</strong>g to apply to dem<strong>on</strong>strate al<strong>on</strong>gwith Wuhan petiti<strong>on</strong>ers Zhang Jianm<strong>in</strong> (肖and Zhou X<strong>in</strong>bao ( 161昌Qi海周 张Zhiy<strong>on</strong>g ( a Beij<strong>in</strong>g activist, was deta<strong>in</strong>ed by Beij<strong>in</strong>g police <strong>on</strong> <strong>the</strong> morn<strong>in</strong>g <strong>of</strong>November 9 after he and a fellow activist applied for permissi<strong>on</strong> to hold a dem<strong>on</strong>strati<strong>on</strong>protest<strong>in</strong>g police harassment dur<strong>in</strong>g President Obama's visit to Ch<strong>in</strong>a. Qi was taken to <strong>the</strong>outskirts <strong>of</strong> Beij<strong>in</strong>g by <strong>of</strong>ficers from <strong>the</strong> Nati<strong>on</strong>al Security Unit <strong>of</strong> <strong>the</strong> Beij<strong>in</strong>g PSB andheld until November 18, <strong>the</strong> c<strong>on</strong>clusi<strong>on</strong> <strong>of</strong> <strong>the</strong> President’s trip.齐However, <strong>the</strong>re were cases <strong>of</strong> human rights defenders be<strong>in</strong>g illegally deta<strong>in</strong>ed <strong>in</strong> blackjails for specific attempts to exercise <strong>the</strong>ir rights, such as Liu Shasha ( ) andMiaojue Cizhi ( Liu and Miaojue were taken <strong>in</strong>to police custody <strong>on</strong> August 3for unfurl<strong>in</strong>g a banner <strong>in</strong> Tiananmen Square and shout<strong>in</strong>g slogans demand<strong>in</strong>g <strong>the</strong> release<strong>of</strong> Xu Zhiy<strong>on</strong>g ( ), <strong>the</strong> deta<strong>in</strong>ed director <strong>of</strong> <strong>the</strong> banned Beij<strong>in</strong>g NGO G<strong>on</strong>gmeng.Liu was deta<strong>in</strong>ed <strong>in</strong> Juyuan Hostel, a “black jail” run by <strong>the</strong> Beij<strong>in</strong>g Liais<strong>on</strong> Office <strong>of</strong> <strong>the</strong>Henan Prov<strong>in</strong>cial Government. Miaojue was held at <strong>the</strong> Beij<strong>in</strong>g Liais<strong>on</strong> Office <strong>of</strong> HeyuanCity, Guangd<strong>on</strong>g Prov<strong>in</strong>ce. Both women escaped from detenti<strong>on</strong> <strong>the</strong> follow<strong>in</strong>g day. 162永 志 许 妙 沙 沙 刘) 民 建).” 宝 新), 勇 志). 智 慈 觉The existence <strong>of</strong> black jails poses a serious threat to human rights defenders. Alldeta<strong>in</strong>ees <strong>in</strong> black jails are at high risk <strong>of</strong> abuse, as violence and mistreatment rema<strong>in</strong>comm<strong>on</strong>place due to <strong>the</strong> lack <strong>of</strong> oversight <strong>of</strong> <strong>the</strong> facilities. There was limited cause foroptimism towards <strong>the</strong> end <strong>of</strong> <strong>the</strong> year, however, as an article appeared <strong>in</strong> November <strong>in</strong>Outlook Weekly, a publicati<strong>on</strong> associated with state-run X<strong>in</strong>hua, detail<strong>in</strong>g <strong>the</strong> use <strong>of</strong> blackjails <strong>in</strong> Beij<strong>in</strong>g. Though <strong>the</strong> story used a different name (“a cha<strong>in</strong> <strong>of</strong> gray enterprises”) torefer to black jails, some observers hoped <strong>the</strong> article, which was <strong>the</strong> first time a high-levelgovernment publicati<strong>on</strong> acknowledged <strong>the</strong> existence <strong>of</strong> black jails, was a sign that moreexposure would be given to <strong>the</strong>ir existence and operati<strong>on</strong> and that <strong>the</strong> central governmentmight beg<strong>in</strong> to take <strong>the</strong> problem seriously. 163b. Adm<strong>in</strong>istrative detenti<strong>on</strong>, <strong>in</strong>clud<strong>in</strong>g Re-educati<strong>on</strong> through Labor (RTL)Dur<strong>in</strong>g 2009, Ch<strong>in</strong>ese <strong>of</strong>ficials c<strong>on</strong>t<strong>in</strong>ued to use <strong>the</strong> extrajudicial adm<strong>in</strong>istrative detenti<strong>on</strong>system to deta<strong>in</strong> human rights defenders.
