<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010The purpose <strong>of</strong> <strong>the</strong>se summ<strong>on</strong>ses rema<strong>in</strong>ed <strong>the</strong> same throughout <strong>the</strong> year: police soughtto track <strong>the</strong> spread <strong>of</strong> <strong>the</strong> Charter by ask<strong>in</strong>g signatories how <strong>the</strong>y came to learn about <strong>the</strong>document, and <strong>of</strong>ten sought to <strong>in</strong>timidate citizens who had signed, threaten<strong>in</strong>g direc<strong>on</strong>sequences if <strong>the</strong>y did not remove <strong>the</strong>ir signatures. However, as a group <strong>of</strong> Charter 08signatories noted <strong>in</strong> November, “<strong>the</strong>re has not been a s<strong>in</strong>gle signatory to Charter 08withdraw<strong>in</strong>g his or her signature.” 134 With reports <strong>of</strong> signatories be<strong>in</strong>g summ<strong>on</strong>ed even asthis report goes to press, <strong>the</strong>re is no <strong>in</strong>dicati<strong>on</strong> that <strong>the</strong> government plans to cease us<strong>in</strong>gthis tactic to harass supporters <strong>of</strong> Charter 08. 135Police c<strong>on</strong>t<strong>in</strong>ued to periodically c<strong>on</strong>duct raids <strong>on</strong> homes <strong>of</strong> human rights defenders <strong>in</strong>c<strong>on</strong>juncti<strong>on</strong> with <strong>the</strong>se summ<strong>on</strong>ses. While usually cautious to provide properdocumentati<strong>on</strong> authoriz<strong>in</strong>g <strong>the</strong>ir acti<strong>on</strong>s, police c<strong>on</strong>duct <strong>the</strong>se searches primarily as ameans <strong>of</strong> <strong>in</strong>timidat<strong>in</strong>g human rights defenders, attempt<strong>in</strong>g to cripple <strong>the</strong>m f<strong>in</strong>ancially, andas a method <strong>of</strong> obta<strong>in</strong><strong>in</strong>g <strong>in</strong>formati<strong>on</strong> about rights-defense activities through c<strong>on</strong>fiscati<strong>on</strong><strong>of</strong> computers, notebooks, and o<strong>the</strong>r items which might c<strong>on</strong>ta<strong>in</strong> lists <strong>of</strong> c<strong>on</strong>tacts, e-mailcorresp<strong>on</strong>dence, or o<strong>the</strong>r evidence <strong>of</strong> a human rights defenders’ c<strong>on</strong>necti<strong>on</strong>s andactivities. Notable raids <strong>in</strong> <strong>the</strong> past year <strong>in</strong>cluded:• A January 10 search <strong>of</strong> Beij<strong>in</strong>g human rights defender Wang Debang’s ( )home. More than twenty policemen, led by <strong>the</strong> head <strong>of</strong> <strong>the</strong> Nati<strong>on</strong>al Security Unit<strong>of</strong> <strong>the</strong> Beij<strong>in</strong>g Municipal PSB arrived late that night to search his home andc<strong>on</strong>fiscate computers and pers<strong>on</strong>al bel<strong>on</strong>g<strong>in</strong>gs. Wang was taken to a PSB <strong>of</strong>ficeand <strong>in</strong>terrogated for six hours about Charter 08 and his alleged <strong>in</strong>volvement <strong>in</strong>draft<strong>in</strong>g A <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2008). 136• A March 31 search <strong>of</strong> <strong>the</strong> Beij<strong>in</strong>g home <strong>of</strong> Dr. Jiang Qisheng (王),德a邦former1989 pris<strong>on</strong>er, dissident writer, and vice-chairman <strong>of</strong> <strong>the</strong> Independent Ch<strong>in</strong>esePEN. Dr. Jiang was taken away from his home <strong>in</strong> Beij<strong>in</strong>g and <strong>in</strong>terrogated bypolice for six hours. Dur<strong>in</strong>g <strong>the</strong> <strong>in</strong>terrogati<strong>on</strong>, police produced a pr<strong>in</strong>t-out copy <strong>of</strong>an article about <strong>the</strong> crackdown <strong>on</strong> <strong>the</strong> protests <strong>of</strong> 1989 that Dr. Jiang was work<strong>in</strong>g<strong>on</strong> from his computer. Police threatened Dr. Jiang and warned him aga<strong>in</strong>stplay<strong>in</strong>g any role <strong>in</strong> organiz<strong>in</strong>g commemorative activities to observe <strong>the</strong> 20thanniversary <strong>of</strong> <strong>the</strong> Tiananmen Square Massacre. Officers c<strong>on</strong>fiscated threecomputers, bank cards, many books, notebooks, and manuscripts from hishome. 137生 棋 江While searches, summ<strong>on</strong>ses, and “chats” may not ultimately lead to a human rightsdefender be<strong>in</strong>g deta<strong>in</strong>ed for an extended period <strong>of</strong> time, <strong>the</strong>y are n<strong>on</strong>e<strong>the</strong>less <strong>in</strong>trusiveand powerful rem<strong>in</strong>ders <strong>of</strong> <strong>the</strong> tenuous nature <strong>of</strong> a human rights defender’s pers<strong>on</strong>alsecurity and liberty. Fur<strong>the</strong>rmore, <strong>the</strong>se police activities are frequently unlawful:<strong>in</strong>vitati<strong>on</strong>s to “tea” which cannot be refused are essentially disguised summ<strong>on</strong>ses, withoutlegal basis, and many <strong>of</strong> <strong>the</strong> summ<strong>on</strong>ses carried out “legally” are used primarily to harassand <strong>in</strong>timidate human rights defenders.b.
