<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010That <strong>the</strong> Ch<strong>in</strong>ese government <strong>in</strong>sists <strong>on</strong> c<strong>on</strong>troll<strong>in</strong>g <strong>the</strong> medium and message <strong>of</strong> humanrights educati<strong>on</strong> comes as no surprise, given its c<strong>on</strong>t<strong>in</strong>ued efforts to restrict freedom <strong>of</strong>expressi<strong>on</strong> and associati<strong>on</strong>. However, by prohibit<strong>in</strong>g <strong>the</strong> <strong>in</strong>volvement <strong>of</strong> civil society, <strong>the</strong>Ch<strong>in</strong>ese government is actively prevent<strong>in</strong>g its citizens from acquir<strong>in</strong>g <strong>the</strong> most up-to-dateand useful <strong>in</strong>formati<strong>on</strong> regard<strong>in</strong>g <strong>the</strong>ir rights, as it is <strong>the</strong> abuses <strong>of</strong> <strong>the</strong>se rights by <strong>the</strong>government that civil society is best suited to help citizens defend. A governmentc<strong>on</strong>trolledplan <strong>of</strong> “human rights educati<strong>on</strong>,” like a government-c<strong>on</strong>trolled media, serves<strong>on</strong>ly to fur<strong>the</strong>r <strong>the</strong> <strong>in</strong>terests <strong>of</strong> <strong>the</strong> authorities.B. Failure to protect human rights defenders1. Every<strong>on</strong>e has <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs, toparticipate <strong>in</strong> peaceful activities aga<strong>in</strong>st violati<strong>on</strong>s <strong>of</strong> human rights andfundamental freedoms.2. The State shall take all necessary measures to ensure <strong>the</strong> protecti<strong>on</strong> by <strong>the</strong>competent authorities <strong>of</strong> every<strong>on</strong>e, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs,aga<strong>in</strong>st any violence, threats, retaliati<strong>on</strong>, de facto or de jure adversediscrim<strong>in</strong>ati<strong>on</strong>, pressure or any o<strong>the</strong>r arbitrary acti<strong>on</strong> as a c<strong>on</strong>sequence <strong>of</strong> his orher legitimate exercise <strong>of</strong> <strong>the</strong> rights referred to <strong>in</strong> <strong>the</strong> present Declarati<strong>on</strong>.3. In this c<strong>on</strong>necti<strong>on</strong>, every<strong>on</strong>e is entitled, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> witho<strong>the</strong>rs, to be protected effectively under nati<strong>on</strong>al law <strong>in</strong> react<strong>in</strong>g aga<strong>in</strong>st oroppos<strong>in</strong>g, through peaceful means, activities and acts, <strong>in</strong>clud<strong>in</strong>g those byomissi<strong>on</strong>, attributable to States that result <strong>in</strong> violati<strong>on</strong>s <strong>of</strong> human rights andfundamental freedoms, as well as acts <strong>of</strong> violence perpetrated by groups or<strong>in</strong>dividuals that affect <strong>the</strong> enjoyment <strong>of</strong> human rights and fundamental freedoms.”- Declarati<strong>on</strong> <strong>on</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong>, Article 12In <strong>the</strong> past year, government <strong>of</strong>ficials not <strong>on</strong>ly failed to protect citizens’ right toparticipate <strong>in</strong> peaceful activities protest<strong>in</strong>g violati<strong>on</strong>s <strong>of</strong> human rights, <strong>the</strong>y <strong>the</strong>mselveswere <strong>the</strong> prime persecutors <strong>of</strong> human rights defenders. <strong>Human</strong> rights defendersc<strong>on</strong>t<strong>in</strong>ued to be subjected to surveillance, threats, physical violence, Re-educati<strong>on</strong>through Labor, arbitrary detenti<strong>on</strong>, and impris<strong>on</strong>ment <strong>in</strong> 2009. Fur<strong>the</strong>rmore, because <strong>of</strong><strong>the</strong> large number <strong>of</strong> “sensitive” events that occurred <strong>in</strong> 2009, <strong>the</strong> government reliedparticularly heavily <strong>on</strong> “s<strong>of</strong>t detenti<strong>on</strong>” and “forced travel” to prevent human rightsdefenders from tak<strong>in</strong>g any public acti<strong>on</strong>s to draw attenti<strong>on</strong> to rights abuses dur<strong>in</strong>g <strong>the</strong>seperiods.In Part I <strong>of</strong> this report, we provided a look at <strong>the</strong> government’s efforts to prevent humanrights defenders from exercis<strong>in</strong>g specific rights <strong>in</strong> 2009. In this secti<strong>on</strong>, we will exam<strong>in</strong>e<strong>the</strong> different ways <strong>in</strong> which <strong>the</strong> government retaliated aga<strong>in</strong>st human rights defenders,and <strong>the</strong> effects <strong>of</strong> <strong>the</strong>se acti<strong>on</strong>s.1.
