<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010governments issued edicts detail<strong>in</strong>g harsher measures, <strong>in</strong>clud<strong>in</strong>g RTL and crim<strong>in</strong>aldetenti<strong>on</strong>, for those who “persist <strong>in</strong> petiti<strong>on</strong><strong>in</strong>g improperly.” 105 “Improper petiti<strong>on</strong><strong>in</strong>g”<strong>in</strong>cludes “ga<strong>the</strong>r<strong>in</strong>g <strong>in</strong> public spaces outside <strong>of</strong> city government <strong>of</strong>fices, shout<strong>in</strong>g slogans,and unfurl<strong>in</strong>g banners dur<strong>in</strong>g petiti<strong>on</strong>s.” 106 For example, petiti<strong>on</strong>er Wang Zhanhe (), a village representative from Lanqi Village, Yushu City, Jil<strong>in</strong> Prov<strong>in</strong>ce was sent to<strong>on</strong>e year <strong>of</strong> RTL for petiti<strong>on</strong><strong>in</strong>g higher authorities <strong>in</strong> Beij<strong>in</strong>g regard<strong>in</strong>g corrupt activitiesby his village’s CCP Secretary. He is currently be<strong>in</strong>g held at <strong>the</strong> Y<strong>in</strong>mahe RTL Camp <strong>in</strong>Changchun City, Jil<strong>in</strong>.河 占 王Veteran petiti<strong>on</strong>ers, for <strong>the</strong> most part, have become used to repeated st<strong>in</strong>ts <strong>in</strong> black jails,RTL camps, or even pris<strong>on</strong>s, and are undeterred by <strong>the</strong>se punishments. Dur<strong>in</strong>g 2009,seas<strong>on</strong>ed petiti<strong>on</strong>ers were very creative <strong>in</strong> generat<strong>in</strong>g opportunities for protests and <strong>in</strong>draw<strong>in</strong>g attenti<strong>on</strong> to <strong>the</strong>ir plight. Petiti<strong>on</strong>ers turned <strong>the</strong> <strong>of</strong>ficial “Nati<strong>on</strong>al Legal PublicityDay” 107 <strong>on</strong> December 4 <strong>in</strong>to “Seek<strong>in</strong>g Redress for Injustice Day,” ga<strong>the</strong>r<strong>in</strong>g en masseoutside <strong>the</strong> State Council Letters and Visits Office and <strong>the</strong> CCTV headquarters. 108 OnNovember 16, dur<strong>in</strong>g US President Obama’s visit to Beij<strong>in</strong>g, about 90 Shanghaipetiti<strong>on</strong>ers traveled to his hotel to “welcome” him, and protest. 109The tenacity and persistence <strong>of</strong> petiti<strong>on</strong>ers sometimes resulted <strong>in</strong> small victories. In lateApril and early May, petiti<strong>on</strong>ers arrived <strong>in</strong> waves at <strong>the</strong> Beij<strong>in</strong>g University campus toprotest aga<strong>in</strong>st <strong>the</strong> claim by <strong>on</strong>e <strong>of</strong> its pr<strong>of</strong>essors, Sun D<strong>on</strong>gd<strong>on</strong>g ( that “99% <strong>of</strong>petiti<strong>on</strong>ers suffer from mental illness.” Although <strong>the</strong>se petiti<strong>on</strong>ers were all taken to blackjails and <strong>the</strong>n forcibly sent home by <strong>in</strong>terceptors and Beij<strong>in</strong>g police, <strong>in</strong> <strong>the</strong> end Sunpublicly apologized for his statement. 110孙b. Adm<strong>in</strong>istrative litigati<strong>on</strong>), 东 东In recent years, Ch<strong>in</strong>ese citizens appeared to be fil<strong>in</strong>g more and more lawsuits aga<strong>in</strong>st <strong>the</strong>government under <strong>the</strong> Adm<strong>in</strong>istrative Litigati<strong>on</strong> Law (ALL), as <strong>the</strong>y became <strong>in</strong>creas<strong>in</strong>glyaware <strong>of</strong> <strong>the</strong>ir rights and <strong>the</strong> channels <strong>the</strong>y could use to seek redress for rightsviolati<strong>on</strong>s. 111 However, <strong>the</strong> latest statistics from 2009 suggest that ord<strong>in</strong>ary people mightbe los<strong>in</strong>g <strong>in</strong>terest <strong>in</strong> <strong>the</strong> ALL system. Accord<strong>in</strong>g to statistics from <strong>the</strong> Supreme People’sCourt (SPC), <strong>the</strong> number <strong>of</strong> ALL cases went down by 11 percent <strong>in</strong> <strong>the</strong> first five m<strong>on</strong>ths<strong>of</strong> 2009 compared with <strong>the</strong> same period <strong>the</strong> previous year. Interest<strong>in</strong>gly, <strong>the</strong> SPCspeculated that such decl<strong>in</strong>e was <strong>the</strong> result <strong>of</strong> a lack <strong>of</strong> trust <strong>in</strong> <strong>the</strong> legal system am<strong>on</strong>gord<strong>in</strong>ary people. 112It rema<strong>in</strong>s very difficult for citizens to w<strong>in</strong> <strong>the</strong>se cases. An <strong>of</strong>ficial estimate from 2007<strong>in</strong>dicated that <strong>on</strong>ly 30% <strong>of</strong> pla<strong>in</strong>tiffs <strong>in</strong> adm<strong>in</strong>istrative litigati<strong>on</strong> lawsuits prevail. 113 Theactual success rate is probably much lower, because <strong>in</strong> many <strong>in</strong>stances courts simplyrefuse to accept ALL cases. In fact, CHRD documented a number <strong>of</strong> cases where lawyersor <strong>the</strong> pla<strong>in</strong>tiffs were told explicitly that <strong>the</strong>ir cases could not be accepted because “higherauthorities” had ordered <strong>the</strong> courts not to accept particular types <strong>of</strong> ALL cases. O<strong>the</strong>rtimes, <strong>the</strong> pla<strong>in</strong>tiffs are threatened and persecuted for fil<strong>in</strong>g <strong>the</strong>se cases aga<strong>in</strong>st <strong>the</strong>government.29
