The rights to participate <strong>in</strong> <strong>the</strong> government and <strong>in</strong> <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> public affairs“1. Every<strong>on</strong>e has <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs, to haveeffective access, <strong>on</strong> a n<strong>on</strong>discrim<strong>in</strong>atory basis, to participati<strong>on</strong> <strong>in</strong> <strong>the</strong> government<strong>of</strong> his or her country and <strong>in</strong> <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> public affairs.2. This <strong>in</strong>cludes, <strong>in</strong>ter alia, <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs,to submit to governmental bodies and agencies and organizati<strong>on</strong>s c<strong>on</strong>cerned withpublic affairs criticism and proposals for improv<strong>in</strong>g <strong>the</strong>ir functi<strong>on</strong><strong>in</strong>g and to drawattenti<strong>on</strong> to any aspect <strong>of</strong> <strong>the</strong>ir work that may h<strong>in</strong>der or impede <strong>the</strong> promoti<strong>on</strong>,protecti<strong>on</strong> and realizati<strong>on</strong> <strong>of</strong> human rights and fundamental freedoms.”- Declarati<strong>on</strong> <strong>on</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong>, Article 8Despite promis<strong>in</strong>g to “expand citizens’ participati<strong>on</strong> <strong>in</strong> political affairs <strong>in</strong> an orderly wayat all levels and <strong>in</strong> all sectors” 77 and “guarantee <strong>the</strong> people’s right <strong>of</strong> democraticsupervisi<strong>on</strong>” 78 <strong>in</strong> its Nati<strong>on</strong>al <strong>Human</strong> <strong>Rights</strong> Acti<strong>on</strong> Plan 2009-2010 (hereafter referred toas “<strong>the</strong> Acti<strong>on</strong> Plan”) published <strong>in</strong> April, <strong>the</strong> Ch<strong>in</strong>ese government rema<strong>in</strong>ed <strong>in</strong>tolerant <strong>of</strong>political organiz<strong>in</strong>g outside <strong>of</strong> its c<strong>on</strong>trol. In 2009, it cracked down harshly <strong>on</strong> <strong>in</strong>dividualswho attempted to organize political parties or made calls for political reform. <strong>Human</strong>rights defenders had no effective means to participate <strong>in</strong> <strong>the</strong> government and <strong>in</strong> <strong>the</strong>c<strong>on</strong>duct <strong>of</strong> public affairs <strong>in</strong> 2009.Political participati<strong>on</strong> was limited to m<strong>on</strong>itor<strong>in</strong>g, vot<strong>in</strong>g, and runn<strong>in</strong>g for <strong>of</strong>fice <strong>in</strong> villagecommittee electi<strong>on</strong>s. Apart from that, <strong>the</strong> primary methods through which ord<strong>in</strong>arycitizens could participate <strong>in</strong> government affairs <strong>in</strong> 2009 were <strong>the</strong> submissi<strong>on</strong> <strong>of</strong> openletters or legislative proposals to <strong>the</strong> government. The government c<strong>on</strong>t<strong>in</strong>ued to solicitop<strong>in</strong>i<strong>on</strong>s <strong>on</strong> draft legislati<strong>on</strong>, and received thousands <strong>of</strong> comments <strong>on</strong> some drafts, but itwas unclear to what extent <strong>the</strong>se comments were taken <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> dur<strong>in</strong>g <strong>the</strong>legislative process. The government proved unwelcom<strong>in</strong>g to any unsolicited proposals,and <strong>in</strong> some cases resp<strong>on</strong>ded to calls for reform, such as Charter 08, with wellcoord<strong>in</strong>atedand wide-reach<strong>in</strong>g retaliati<strong>on</strong>. Likewise, if human rights defenders voiced<strong>the</strong>ir op<strong>in</strong>i<strong>on</strong>s <strong>on</strong> how local <strong>of</strong>ficials c<strong>on</strong>ducted village electi<strong>on</strong>s—by protest<strong>in</strong>g about <strong>the</strong>outcome, or publiciz<strong>in</strong>g vot<strong>in</strong>g irregularities, for example—<strong>the</strong>y risked punishment.1. Open letters and legislative proposalsMost open letters were addressed to <strong>the</strong> government and its leaders at <strong>the</strong> central level,such as members <strong>of</strong> <strong>the</strong> Nati<strong>on</strong>al People’s C<strong>on</strong>gress (NPC), but some were directed to<strong>of</strong>ficials at <strong>the</strong> prov<strong>in</strong>cial or local level. 79 The letter drafters, as well as <strong>the</strong>ir topics anddemands, were diverse. For example:• A number <strong>of</strong> lawyers and activists released a public letter <strong>on</strong> December 17 to<strong>of</strong>ficial media outlets, demand<strong>in</strong>g aboliti<strong>on</strong> <strong>of</strong> Article 306 <strong>of</strong> <strong>the</strong> Crim<strong>in</strong>al Law 80and criticiz<strong>in</strong>g <strong>the</strong> press for what <strong>the</strong>y believed to be biased or <strong>in</strong>correct report<strong>in</strong>gregard<strong>in</strong>g <strong>the</strong> case <strong>of</strong> Li Zhuang ( a Beij<strong>in</strong>g lawyer who was tried for 李21庄 ),
