When <strong>the</strong> villagers learnedabout <strong>the</strong> c<strong>on</strong>tract <strong>on</strong> October 30, hundreds <strong>of</strong> <strong>the</strong>m ga<strong>the</strong>red to prevent <strong>the</strong> demoliti<strong>on</strong>from be<strong>in</strong>g carried out. Between 200 and 300 police <strong>of</strong>ficers and local <strong>of</strong>ficials went to<strong>the</strong> scene, and <strong>in</strong> <strong>the</strong> ensu<strong>in</strong>g c<strong>on</strong>flict ten villagers were seized and two elderly residentshad to be hospitalized. Police also put village leaders under surveillance, and village chiefXu, who had been lead<strong>in</strong>g <strong>the</strong> villagers’ struggle to resist <strong>the</strong> seizure, fled <strong>the</strong> village andwent <strong>in</strong>to hid<strong>in</strong>g. 92Through solicit<strong>in</strong>g <strong>in</strong>put <strong>on</strong> pend<strong>in</strong>g legislati<strong>on</strong> and allow<strong>in</strong>g tightly-c<strong>on</strong>trolled villageelecti<strong>on</strong>s, <strong>the</strong> Ch<strong>in</strong>ese government might be able to assert and even produce statistics tosupport its claim that it “guarantees <strong>the</strong> people’s right <strong>of</strong> democratic supervisi<strong>on</strong>.” 93However, when this asserti<strong>on</strong> is juxtaposed with <strong>the</strong> abuses documented at <strong>the</strong> grassrootslevel, such as those <strong>in</strong>cluded here, an entirely different picture becomes clear.D. The right to a benefit from an effective remedy when a right is violated1. In <strong>the</strong> exercise <strong>of</strong> human rights and fundamental freedoms, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong>promoti<strong>on</strong> and protecti<strong>on</strong> <strong>of</strong> human rights as referred to <strong>in</strong> <strong>the</strong> [Declarati<strong>on</strong> <strong>on</strong><strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong>], every<strong>on</strong>e has <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong>with o<strong>the</strong>rs, to benefit from an effective remedy and to be protected <strong>in</strong> <strong>the</strong> event <strong>of</strong><strong>the</strong> violati<strong>on</strong> <strong>of</strong> those rights.2. To this end, every<strong>on</strong>e whose rights or freedoms are allegedly violated has <strong>the</strong>right, ei<strong>the</strong>r <strong>in</strong> pers<strong>on</strong> or through legally authorized representati<strong>on</strong>, to compla<strong>in</strong>to and have that compla<strong>in</strong>t promptly reviewed <strong>in</strong> a public hear<strong>in</strong>g before an<strong>in</strong>dependent, impartial and competent judicial or o<strong>the</strong>r authority established bylaw and to obta<strong>in</strong> from such an authority a decisi<strong>on</strong>, <strong>in</strong> accordance with law,provid<strong>in</strong>g redress, <strong>in</strong>clud<strong>in</strong>g any compensati<strong>on</strong> due, where <strong>the</strong>re has been aviolati<strong>on</strong> <strong>of</strong> that pers<strong>on</strong>’s rights or freedoms, as well as enforcement <strong>of</strong> <strong>the</strong>eventual decisi<strong>on</strong> and award, all without undue delay.3. Perhaps mostnotably, this year saw an unprecedented number <strong>of</strong> lawyers threatened with pr<strong>of</strong>essi<strong>on</strong>alc<strong>on</strong>sequences for handl<strong>in</strong>g <strong>the</strong>se cases, as well as rare, but serious, cases <strong>of</strong> lawyers whowere attacked, impris<strong>on</strong>ed, or forcibly disappeared <strong>in</strong> retaliati<strong>on</strong> for <strong>the</strong>ir work. As <strong>the</strong>seacti<strong>on</strong>s came <strong>in</strong> tandem with <strong>of</strong>ficials’ c<strong>on</strong>t<strong>in</strong>ued violati<strong>on</strong> <strong>of</strong> deta<strong>in</strong>ees’ right to legalcounsel, <strong>the</strong> ability <strong>of</strong> lawyers to effectively provide a defense for human rights defendersand o<strong>the</strong>r citizens deta<strong>in</strong>ed for exercis<strong>in</strong>g <strong>the</strong>ir rights took a tangible step backwards <strong>in</strong><strong>the</strong> past year.Fur<strong>the</strong>rmore, citizens who turned to <strong>the</strong> petiti<strong>on</strong><strong>in</strong>g system <strong>in</strong> hopes <strong>of</strong> obta<strong>in</strong><strong>in</strong>g justice<strong>in</strong> 2009 found <strong>the</strong>mselves faced with ever harsher treatment. Police, government <strong>of</strong>ficials,and <strong>in</strong>terceptors c<strong>on</strong>t<strong>in</strong>ued to harass, kidnap, and deta<strong>in</strong> petiti<strong>on</strong>ers <strong>in</strong> Beij<strong>in</strong>g and across<strong>the</strong> country <strong>in</strong> 2009, and as this past year saw a higher-than-average number <strong>of</strong>“sensitive” dates, <strong>the</strong> nati<strong>on</strong>wide roundups <strong>of</strong> petiti<strong>on</strong>ers which have become comm<strong>on</strong>before <strong>the</strong>se events took place with greater frequency.F<strong>in</strong>ally, o<strong>the</strong>r less direct, though no less serious, violati<strong>on</strong>s <strong>of</strong> <strong>the</strong> right to benefit from aneffective remedy <strong>in</strong> cases <strong>of</strong> rights abuses c<strong>on</strong>t<strong>in</strong>ued <strong>in</strong> <strong>the</strong> past year. For example, <strong>the</strong>government used a variety <strong>of</strong> methods to prevent <strong>the</strong> public from attend<strong>in</strong>g open trials <strong>in</strong>cases aga<strong>in</strong>st human rights defenders. The overall result <strong>of</strong> government acti<strong>on</strong>s <strong>in</strong> 2009was to c<strong>on</strong>tribute to a decl<strong>in</strong>e <strong>in</strong> citizens’ trust <strong>in</strong> <strong>the</strong> legal system, a trend which couldhave serious implicati<strong>on</strong>s for <strong>the</strong> way <strong>in</strong> which human rights defenders and o<strong>the</strong>rs seek toresp<strong>on</strong>d to rights abuses <strong>in</strong> <strong>the</strong> future.1. The right to <strong>of</strong>fer and provide pr<strong>of</strong>essi<strong>on</strong>ally qualified legal assistanceLawyers who take <strong>on</strong> cases deemed “sensitive” by <strong>the</strong> Ch<strong>in</strong>ese government, and thosewho provide crim<strong>in</strong>al defense to political pris<strong>on</strong>ers, human rights defenders, ethnicm<strong>in</strong>orities and o<strong>the</strong>r “sensitive” groups, faced <strong>in</strong>creased persecuti<strong>on</strong> <strong>in</strong> 2009. Asignificant number <strong>of</strong> <strong>the</strong>se human rights lawyers suffered vary<strong>in</strong>g degrees <strong>of</strong> harassment,<strong>in</strong>timidati<strong>on</strong>, and suppressi<strong>on</strong>. Some were beaten, deta<strong>in</strong>ed or <strong>in</strong>carcerated. O<strong>the</strong>rs werefired from <strong>the</strong>ir law firms or stripped <strong>of</strong> <strong>the</strong>ir licenses to practice law. Prom<strong>in</strong>ent humanrights attorney Gao Zhisheng ( ) disappeared <strong>on</strong> February 4 and resurfaced <strong>on</strong>lyrecently, <strong>in</strong> April 2010, follow<strong>in</strong>g allegati<strong>on</strong>s <strong>of</strong> torture and cruel treatment by securitypolice (see Gao’s case <strong>on</strong> p.39).晟 智 高In May, authorities threatened to revoke <strong>the</strong> lawyers’ licenses <strong>of</strong> a group <strong>of</strong> about 20human rights lawyers. This acti<strong>on</strong> was widely believed to be <strong>in</strong> resp<strong>on</strong>se to <strong>the</strong>ir work <strong>on</strong>“sensitive” human rights cases. Officials from local Bureaus <strong>of</strong> Justice and variouslawyers associati<strong>on</strong>s pressured law firms at which <strong>the</strong>se lawyers worked to “coord<strong>in</strong>ate”with <strong>the</strong> authorities by ei<strong>the</strong>r term<strong>in</strong>at<strong>in</strong>g <strong>the</strong>ir c<strong>on</strong>tracts or “fail<strong>in</strong>g” <strong>the</strong>m <strong>in</strong> <strong>the</strong> annualevaluati<strong>on</strong> <strong>of</strong> <strong>the</strong>ir performances. Without hav<strong>in</strong>g <strong>the</strong>ir licenses renewed by <strong>the</strong> Bureau <strong>of</strong>Justice, <strong>the</strong>se lawyers could still provide legal advice, but could no l<strong>on</strong>ger <strong>of</strong>fer <strong>the</strong> range<strong>of</strong> services provided by registered lawyers, such as represent<strong>in</strong>g <strong>the</strong>ir clients <strong>in</strong> court.
