<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010In additi<strong>on</strong> to detenti<strong>on</strong> and arrest, police and government <strong>of</strong>ficials c<strong>on</strong>t<strong>in</strong>ued to use anarray <strong>of</strong> alternative methods to exert pressure <strong>on</strong> human rights defenders <strong>in</strong> 2009. Formany human rights defenders, harassment and threats have become comm<strong>on</strong>place. Forexample, s<strong>in</strong>ce his release from three years <strong>in</strong> pris<strong>on</strong> <strong>on</strong> June 2, 2006, debarred humanrights lawyer Zheng Ench<strong>on</strong>g ( has been summ<strong>on</strong>ed for questi<strong>on</strong><strong>in</strong>g by Shanghaipolice 76 times as <strong>of</strong> January 3. 127 While call<strong>in</strong>g activists <strong>in</strong> for a “chat,” to “tea,” orsumm<strong>on</strong><strong>in</strong>g <strong>the</strong>m for <strong>in</strong>terrogati<strong>on</strong> were am<strong>on</strong>g <strong>the</strong> most comm<strong>on</strong> forms <strong>of</strong> policeharassment, restrict<strong>in</strong>g activists’ movements, particularly around events <strong>of</strong> nati<strong>on</strong>alsignificance, c<strong>on</strong>t<strong>in</strong>ued to be widely practiced by police as well.郑) 宠 恩a. “Chats,” “teas,” summ<strong>on</strong>s, and searchesFor many human rights defenders, <strong>the</strong>ir first <strong>in</strong>teracti<strong>on</strong> with <strong>the</strong> police, be <strong>the</strong>y from <strong>the</strong>Public Security Bureau (g<strong>on</strong>gan), <strong>the</strong> Nati<strong>on</strong>al Security Unit (guobao) under <strong>the</strong> PSB, <strong>the</strong>M<strong>in</strong>istry <strong>of</strong> State Security (guoan), or any o<strong>the</strong>r uniformed or pla<strong>in</strong>clo<strong>the</strong>s <strong>of</strong>ficial, comes<strong>in</strong> <strong>the</strong> form <strong>of</strong> a “chat” or an <strong>in</strong>vitati<strong>on</strong> to “dr<strong>in</strong>k tea.” These acti<strong>on</strong>s have a number <strong>of</strong><strong>in</strong>tended effects: to let <strong>in</strong>dividuals know that <strong>the</strong> police are aware <strong>of</strong> <strong>the</strong>ir activities, toga<strong>the</strong>r <strong>in</strong>formati<strong>on</strong> about that pers<strong>on</strong>’s relati<strong>on</strong>ships and c<strong>on</strong>tacts, to clearly warn <strong>the</strong>maga<strong>in</strong>st certa<strong>in</strong> pursuits, and so <strong>on</strong>. Because human rights defenders are <strong>of</strong>ten warned notto discuss <strong>the</strong>ir “chats,” or are so frequently harassed by police that <strong>the</strong>y have gotten usedto <strong>the</strong>se acts <strong>of</strong> <strong>in</strong>timidati<strong>on</strong>, <strong>the</strong> use <strong>of</strong> this tactic is <strong>of</strong>ten not reported or documented.However, CHRD believes that it is very likely that police had more “chats” with humanrights defenders <strong>in</strong> 2009 than <strong>in</strong> previous years.While an <strong>in</strong>vitati<strong>on</strong> for “tea” or a “chat,” is made <strong>in</strong>formally by a police <strong>of</strong>ficer, asumm<strong>on</strong>s (chuanhuan) is a different story altoge<strong>the</strong>r. The procedure for summ<strong>on</strong><strong>in</strong>g acitizen for questi<strong>on</strong><strong>in</strong>g is outl<strong>in</strong>ed <strong>in</strong> <strong>the</strong> Crim<strong>in</strong>al Procedure Law, and <strong>in</strong>terrogati<strong>on</strong>s arelimited to no more than 12 hours. Though police are legally required to issue a formalsumm<strong>on</strong>s notice, 128 CHRD has documented numerous cases <strong>in</strong> which <strong>of</strong>ficers havearrived at <strong>the</strong> home <strong>of</strong> a human rights defender and orally <strong>in</strong>formed <strong>the</strong>m that <strong>the</strong>y werebe<strong>in</strong>g summ<strong>on</strong>ed for questi<strong>on</strong><strong>in</strong>g without produc<strong>in</strong>g any legal documents. 129 In <strong>the</strong> pastyear, summ<strong>on</strong>ses were used particularly heavily: accord<strong>in</strong>g to <strong>on</strong>e estimate, more humanrights defenders were summ<strong>on</strong>ed for questi<strong>on</strong><strong>in</strong>g <strong>in</strong> 2009 than <strong>in</strong> any year s<strong>in</strong>ce 1989. 130This was largely due to <strong>the</strong> government’s anxiety regard<strong>in</strong>g Charter 08.The Ch<strong>in</strong>ese government began summ<strong>on</strong><strong>in</strong>g and <strong>in</strong>terrogat<strong>in</strong>g signatories <strong>of</strong> Charter 08even before it was released: Zhang Zuhua ( and Liu Xiaobo ( weresumm<strong>on</strong>ed for questi<strong>on</strong><strong>in</strong>g <strong>on</strong> <strong>the</strong> night <strong>of</strong> December 8, 2008. 131 While Zhang wasreleased after 12 hours, Liu was placed under residential surveillance and held <strong>in</strong> a secretlocati<strong>on</strong> until his formal arrest more than 6 m<strong>on</strong>ths later. With<strong>in</strong> a week, nearly 40signatories were summ<strong>on</strong>ed. 132 By December 2009, <strong>the</strong> <strong>on</strong>e-year anniversary <strong>of</strong> <strong>the</strong>release <strong>of</strong> Charter 08, <strong>the</strong> government had summ<strong>on</strong>ed over 100 Charter 08 signatories,some <strong>on</strong> multiple occasi<strong>on</strong>s. 133 With <strong>the</strong> excepti<strong>on</strong> <strong>of</strong> Liu, n<strong>on</strong>e <strong>of</strong> <strong>the</strong> signatories havebeen arrested for <strong>the</strong>ir support for Charter 08.刘 张36) 桦 祖) 波 晓
