<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010Part I: An Assessment <strong>of</strong> <strong>Rights</strong> Essential for Defend<strong>in</strong>g <strong>Human</strong> <strong>Rights</strong>Throughout 2009, <strong>the</strong> Ch<strong>in</strong>ese government c<strong>on</strong>t<strong>in</strong>ued to rely <strong>on</strong> exist<strong>in</strong>g methods <strong>of</strong>c<strong>on</strong>trol to restrict <strong>the</strong> rights accorded to human rights defenders. For several key areas <strong>in</strong>which citizens have dem<strong>on</strong>strated <strong>the</strong> most activism <strong>in</strong> recent years, however, <strong>the</strong>government stepped up its efforts to re<strong>in</strong> <strong>in</strong> any fur<strong>the</strong>r growth:• Freedom <strong>of</strong> associati<strong>on</strong>: The government shut down G<strong>on</strong>gmeng, a successful civilsociety organizati<strong>on</strong> known for its <strong>in</strong>novative work promot<strong>in</strong>g human rights andequality. Beij<strong>in</strong>g police also briefly deta<strong>in</strong>ed its director and <strong>on</strong>e <strong>of</strong> its staff members.The move sent a chill through Ch<strong>in</strong>a’s civil society and served as a warn<strong>in</strong>g to o<strong>the</strong>rsimilar organizati<strong>on</strong>s <strong>in</strong> Beij<strong>in</strong>g.• Freedom <strong>of</strong> expressi<strong>on</strong> <strong>on</strong> <strong>the</strong> <strong>in</strong>ternet: The government <strong>in</strong>itiated several policiesand campaigns to streng<strong>the</strong>n its grip over <strong>the</strong> <strong>in</strong>ternet, which has c<strong>on</strong>t<strong>in</strong>ued toprovide fertile ground for citizen activism.• The right to compla<strong>in</strong>: The government adopted a harsher attitude towardspetiti<strong>on</strong>ers, and <strong>in</strong>stituti<strong>on</strong>alized more severe punishment for those who c<strong>on</strong>t<strong>in</strong>ue topetiti<strong>on</strong>.• The right to provide legal assistance: Twenty human rights lawyers were deniedrenewal <strong>of</strong> <strong>the</strong>ir licenses by <strong>the</strong> Beij<strong>in</strong>g Bureau <strong>of</strong> Justice <strong>in</strong> May, and as <strong>of</strong> <strong>the</strong> time<strong>of</strong> writ<strong>in</strong>g, eight had still been unable to obta<strong>in</strong> renewals. Fur<strong>the</strong>rmore, a number <strong>of</strong>lawyers were assaulted, deta<strong>in</strong>ed, impris<strong>on</strong>ed and harassed for defend<strong>in</strong>g humanrights <strong>in</strong> <strong>the</strong> past year.A. The rights to freedom <strong>of</strong> assembly and associati<strong>on</strong>For <strong>the</strong> purpose <strong>of</strong> promot<strong>in</strong>g and protect<strong>in</strong>g human rights and fundamentalfreedoms, every<strong>on</strong>e has <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs, at<strong>the</strong> nati<strong>on</strong>al and <strong>in</strong>ternati<strong>on</strong>al levels:(a) To meet or assemble peacefully;(b) To form, jo<strong>in</strong> and participate <strong>in</strong> n<strong>on</strong>-governmental organizati<strong>on</strong>s, associati<strong>on</strong>sor groups;(c) To communicate with n<strong>on</strong>-governmental or <strong>in</strong>tergovernmental organizati<strong>on</strong>s.- Declarati<strong>on</strong> <strong>on</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong>, Article 5Every<strong>on</strong>e has <strong>the</strong> right, <strong>in</strong>dividually and <strong>in</strong> associati<strong>on</strong> with o<strong>the</strong>rs, to solicit,receive and utilize resources for <strong>the</strong> express purpose <strong>of</strong> promot<strong>in</strong>g and protect<strong>in</strong>ghuman rights and fundamental freedoms through peaceful means, <strong>in</strong> accordancewith Article 3 <strong>of</strong> <strong>the</strong> present Declarati<strong>on</strong>.- Declarati<strong>on</strong> <strong>on</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong>, Article 13The past year saw no tangible relaxati<strong>on</strong> <strong>of</strong> <strong>the</strong> government’s tight c<strong>on</strong>trol over freedom<strong>of</strong> associati<strong>on</strong> and assembly. Laws and regulati<strong>on</strong>s limit<strong>in</strong>g <strong>the</strong> formati<strong>on</strong> <strong>of</strong> associati<strong>on</strong>sor <strong>the</strong> hold<strong>in</strong>g <strong>of</strong> dem<strong>on</strong>strati<strong>on</strong>s rema<strong>in</strong>ed <strong>in</strong> place. Fur<strong>the</strong>rmore, <strong>the</strong> Ch<strong>in</strong>esegovernment took steps to limit <strong>the</strong> already-c<strong>on</strong>stricted space for <strong>in</strong>dependent associati<strong>on</strong>s.7
