<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010• In August, <strong>the</strong> family <strong>of</strong> Liu Fengq<strong>in</strong> ( ), a 66-year-old petiti<strong>on</strong>er fromTangshan City, Hebei Prov<strong>in</strong>ce, who was serv<strong>in</strong>g an RTL sentence for petiti<strong>on</strong><strong>in</strong>g,attempted to challenge her detenti<strong>on</strong> through adm<strong>in</strong>istrative litigati<strong>on</strong>. When <strong>the</strong>family went to <strong>the</strong> district court to file <strong>the</strong> suit, <strong>the</strong> presid<strong>in</strong>g judge told <strong>the</strong>m that“higher authorities” had issued guidel<strong>in</strong>es forbidd<strong>in</strong>g courts from hear<strong>in</strong>g casesfiled by petiti<strong>on</strong>ers challeng<strong>in</strong>g <strong>the</strong>ir RTL decisi<strong>on</strong>s. Liu, whose health was verypoor, died <strong>in</strong> <strong>the</strong> RTL camp <strong>on</strong> September 23. 114• On July 29, a group <strong>of</strong> human rights defenders from Guiyang City, GuizhouProv<strong>in</strong>ce filed an adm<strong>in</strong>istrative litigati<strong>on</strong> lawsuit aga<strong>in</strong>st <strong>the</strong> Guiyang City PSBat <strong>the</strong> Guiyang City Intermediate People’s Court. The activists alleged that <strong>the</strong>yhad suffered beat<strong>in</strong>gs, illegal detenti<strong>on</strong> and o<strong>the</strong>r illegal treatment at <strong>the</strong> hands <strong>of</strong><strong>the</strong> police. The court told <strong>the</strong> group that <strong>the</strong> applicati<strong>on</strong> could not be accepted刘 凤 芹because it was not <strong>in</strong> <strong>the</strong> correct format. Eventually, <strong>the</strong> court took <strong>the</strong> applicati<strong>on</strong>and told <strong>the</strong> group to come back a week later. The group returned <strong>in</strong> a week, <strong>on</strong>lyto be told that <strong>the</strong> court could not accept <strong>the</strong> case because <strong>the</strong>y could not file anadm<strong>in</strong>istrative lawsuit with diverse compla<strong>in</strong>ts and that <strong>the</strong>y lacked <strong>the</strong> legaldocuments support<strong>in</strong>g <strong>the</strong> case, such as summ<strong>on</strong>s and detenti<strong>on</strong> warrants. Theactivists po<strong>in</strong>ted out that <strong>the</strong>y were su<strong>in</strong>g <strong>the</strong> police partly because <strong>the</strong> policefailed to produce <strong>the</strong>se documents when deta<strong>in</strong><strong>in</strong>g <strong>the</strong>m. 115With experiences like <strong>the</strong>se, it comes as little surprise that citizens have begun toaband<strong>on</strong> <strong>the</strong> ALL system. However, should this trend c<strong>on</strong>t<strong>in</strong>ue <strong>in</strong>to <strong>the</strong> future, it wouldbe damag<strong>in</strong>g not <strong>on</strong>ly for citizens seek<strong>in</strong>g resoluti<strong>on</strong> <strong>of</strong> adm<strong>in</strong>istrative compla<strong>in</strong>ts, but forall citizens who attempt to hold government <strong>of</strong>ficials accountable for rights abuses.c. The right to attend public hear<strong>in</strong>gs, proceed<strong>in</strong>gs and trialsExcept for cases which <strong>in</strong>volve state secrets, privacy, or juvenile defendants, hear<strong>in</strong>gs <strong>of</strong>crim<strong>in</strong>al cases are open to <strong>the</strong> public. 116 Any Ch<strong>in</strong>ese citizen except those who are“mentally ill, drunk, or a m<strong>in</strong>or without <strong>the</strong> approval <strong>of</strong> <strong>the</strong> People’s Court” can attendpublic court hear<strong>in</strong>gs, accord<strong>in</strong>g to provisi<strong>on</strong>s issued by <strong>the</strong> Supreme People’s Court. 117However, CHRD has documented numerous cases <strong>in</strong> which policemen and court <strong>of</strong>ficialsprevented supporters from enter<strong>in</strong>g <strong>the</strong> courthouse to attend “public” hear<strong>in</strong>gs <strong>of</strong>dissidents and human rights activists.Several standard explanati<strong>on</strong>s are given to <strong>the</strong> frustrated supporters: that <strong>the</strong>y have notapplied to attend <strong>the</strong> trial beforehand, that <strong>the</strong>y have been listed as “witnesses” so <strong>the</strong>ycannot observe <strong>the</strong> trial unless summ<strong>on</strong>ed, and that <strong>the</strong> court is already full. Policemenare mobilized by local governments and, depend<strong>in</strong>g <strong>on</strong> <strong>the</strong> sensitivity <strong>of</strong> <strong>the</strong> case, <strong>on</strong>e ormore <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g tactics are used by <strong>the</strong> police to physically prevent supporters fromattend<strong>in</strong>g <strong>the</strong> trial: some <strong>of</strong> <strong>the</strong> known supporters are subjected to “s<strong>of</strong>t detenti<strong>on</strong>” athome before <strong>the</strong> trial starts; o<strong>the</strong>r supporters are prevented from reach<strong>in</strong>g <strong>the</strong> court bycheckpo<strong>in</strong>ts setup <strong>on</strong> <strong>the</strong> roads lead<strong>in</strong>g to <strong>the</strong> court; o<strong>the</strong>rs are taken <strong>in</strong>to custody outside<strong>of</strong> <strong>the</strong> courthouse, or threatened and assaulted if <strong>the</strong>y try to enter <strong>the</strong> courthouse.30

The courtroom was o<strong>the</strong>rwise filled withpla<strong>in</strong>clo<strong>the</strong>s police or government <strong>of</strong>ficials. Meanwhile, outside <strong>of</strong> <strong>the</strong> courthouse,uniformed <strong>of</strong>ficers blocked <strong>the</strong> entrances and patrolled <strong>the</strong> surround<strong>in</strong>g area toprevent o<strong>the</strong>rs from attempt<strong>in</strong>g to enter. Journalists were also reportedly takenaway by <strong>of</strong>ficials to prevent <strong>the</strong>m from report<strong>in</strong>g <strong>on</strong> <strong>the</strong> trial. 118• The trial <strong>of</strong> Liu Xiaobo (范)燕was琼also essentially closed to <strong>the</strong> public, eventhough it was supposed to be a public hear<strong>in</strong>g. With <strong>the</strong> excepti<strong>on</strong> <strong>of</strong> two familymembers—Liu’s younger bro<strong>the</strong>r and his bro<strong>the</strong>r-<strong>in</strong>-law—all o<strong>the</strong>r spectators <strong>in</strong><strong>the</strong> small courtroom were young males <strong>in</strong> pla<strong>in</strong> clo<strong>the</strong>s, who were believed to be吴 华 英 游 精 佑<strong>of</strong>ficials. Dozens <strong>of</strong> supporters, as well as reporters and diplomats, were barredfrom observ<strong>in</strong>g <strong>the</strong> trial by security guards who blocked <strong>the</strong> entrance to <strong>the</strong> court.The guards told <strong>the</strong> group that all permits to observe <strong>the</strong> trial had been given刘out.Liu’s wife, Liu Xia ( was also denied a permit to attend as well after <strong>the</strong>authorities listed her as a witness for <strong>the</strong> prosecuti<strong>on</strong>. Police stood outside herapartment to block her from leav<strong>in</strong>g or receiv<strong>in</strong>g visitors dur<strong>in</strong>g her husband’strial. Several dozen prom<strong>in</strong>ent Beij<strong>in</strong>g-based activists and dissidents wereprevented from leav<strong>in</strong>g <strong>the</strong>ir homes, and a晓 波dozen or so o<strong>the</strong>r supporters weredeta<strong>in</strong>ed <strong>on</strong> <strong>the</strong>ir way to <strong>the</strong> trial. 119刘Even when <strong>the</strong>y stop short <strong>of</strong> physically restra<strong>in</strong><strong>in</strong>g attendees, <strong>the</strong> government relies <strong>on</strong>o<strong>the</strong>r underhanded tactics to hold “open” trials without actually allow<strong>in</strong>g <strong>the</strong> public toobserve. In pursu<strong>in</strong>g <strong>the</strong>se means <strong>of</strong> limit<strong>in</strong>g access to trials, <strong>the</strong> government not <strong>on</strong>lydenies defendants <strong>the</strong>ir right to a public hear<strong>in</strong>g, it also underm<strong>in</strong>es its stated goal <strong>of</strong><strong>in</strong>creas<strong>in</strong>g legal educati<strong>on</strong>. If members <strong>of</strong> <strong>the</strong> public and <strong>the</strong> media are barred fromobserv<strong>in</strong>g and report<strong>in</strong>g <strong>on</strong> trials <strong>of</strong> human rights defenders, society as a whole isdeprived <strong>of</strong> critical knowledge <strong>of</strong> <strong>the</strong> work<strong>in</strong>gs <strong>of</strong> <strong>the</strong>ir legal system.霞 ),31
