Crim<strong>in</strong>al detenti<strong>on</strong>To send a stern warn<strong>in</strong>g to society as a whole and to punish human rights defenderswhose acti<strong>on</strong>s more directly challenge <strong>the</strong> status quo, <strong>the</strong> government c<strong>on</strong>t<strong>in</strong>ued to rely<strong>on</strong> <strong>the</strong> crim<strong>in</strong>al justice system to prosecute human rights defenders <strong>in</strong> 2009. The charges<strong>of</strong> “<strong>in</strong>cit<strong>in</strong>g subversi<strong>on</strong> <strong>of</strong> state power,” “subversi<strong>on</strong> <strong>of</strong> state power,” and “illegalpossessi<strong>on</strong> <strong>of</strong> state secrets” were used to crim<strong>in</strong>alize c<strong>on</strong>stituti<strong>on</strong>ally-protected freespeech. In additi<strong>on</strong>, <strong>the</strong> crime <strong>of</strong> “ga<strong>the</strong>r<strong>in</strong>g a crowd to disrupt social order” was used toprosecute citizens exercis<strong>in</strong>g <strong>the</strong>ir right to freedom <strong>of</strong> assembly, while <strong>the</strong> crime <strong>of</strong>“mak<strong>in</strong>g false accusati<strong>on</strong>s” was used to impris<strong>on</strong> activists who exposed corrupti<strong>on</strong> andgovernment malfeasance <strong>in</strong> <strong>the</strong> media. In many cases dur<strong>in</strong>g <strong>the</strong> past year, <strong>the</strong>government not <strong>on</strong>ly c<strong>on</strong>victed human rights defenders <strong>of</strong> o<strong>the</strong>rs <strong>of</strong> <strong>the</strong>se and o<strong>the</strong>r n<strong>on</strong>violentcrimes, but handed down heavy sentences.Dissidents and political activists received <strong>the</strong> harshest sentences am<strong>on</strong>g human rightsdefenders <strong>in</strong> 2009, signal<strong>in</strong>g that <strong>the</strong> government’s overrid<strong>in</strong>g c<strong>on</strong>cern rema<strong>in</strong>ed stifl<strong>in</strong>gany perceived challenges to <strong>the</strong> CCP’s <strong>on</strong>e-party rule. Two political organizers—GuoQuan ( ) and Xie Changfa ( )—were sentenced to 10 and 13 years,respectively, for “subversi<strong>on</strong> <strong>of</strong> state power” (see also p.5). And, as discussed previously<strong>in</strong> this report, dissident <strong>in</strong>tellectual Liu Xiaobo was sentenced to 11 years <strong>in</strong> pris<strong>on</strong> for“<strong>in</strong>cit<strong>in</strong>g subversi<strong>on</strong> <strong>of</strong> state power” largely for his role <strong>in</strong> draft<strong>in</strong>g Charter 08, whichalso calls for <strong>the</strong> end <strong>of</strong> <strong>on</strong>e-party rule <strong>in</strong> Ch<strong>in</strong>a.发 长 谢 泉 郭Two o<strong>the</strong>r human rights defenders c<strong>on</strong>victed <strong>of</strong> “<strong>in</strong>cit<strong>in</strong>g subversi<strong>on</strong> <strong>of</strong> state power,” TanZuoren ( ) and Yuan Xianchen ( ), were sentenced to five and four years <strong>in</strong>pris<strong>on</strong>, respectively. Tan, who was sentenced <strong>in</strong> early 2010, was punished for post<strong>in</strong>garticles commemorat<strong>in</strong>g <strong>the</strong> 20 th anniversary <strong>of</strong> <strong>the</strong> Tiananmen Square Massacre. 172However, it is believed that his work to <strong>in</strong>vestigate <strong>the</strong> deaths <strong>of</strong> schoolchildren <strong>in</strong> <strong>the</strong>2008 Sichuan earthquake was <strong>the</strong> ma<strong>in</strong> cause <strong>of</strong> <strong>the</strong> government’s retaliati<strong>on</strong>. Yuan, whowas tried <strong>in</strong> January and sentenced <strong>in</strong> March, was c<strong>on</strong>victed <strong>of</strong> “<strong>in</strong>cit<strong>in</strong>g subversi<strong>on</strong>” foraccept<strong>in</strong>g <strong>in</strong>terviews with foreign news outlets, accept<strong>in</strong>g foreign fund<strong>in</strong>g for his work,and distribut<strong>in</strong>g articles <strong>on</strong> c<strong>on</strong>stituti<strong>on</strong>al democracy. His c<strong>on</strong>victi<strong>on</strong> came <strong>in</strong> retaliati<strong>on</strong>for his legal aid work <strong>in</strong> Jixi City, Shand<strong>on</strong>g Prov<strong>in</strong>ce, and for assist<strong>in</strong>g <strong>the</strong> collecti<strong>on</strong> <strong>of</strong>signatures for a public petiti<strong>on</strong> entitled “We Want <strong>Human</strong> <strong>Rights</strong>, not <strong>the</strong> Olympics.” 173臣 显 袁 人 作 谭In additi<strong>on</strong> to human rights defenders sentenced to pris<strong>on</strong> <strong>in</strong> 2009 (see Appendix I forselected cases) CHRD has also documented a number <strong>of</strong> human rights defenderscurrently <strong>in</strong>volved <strong>in</strong> pend<strong>in</strong>g prosecuti<strong>on</strong>s. While <strong>the</strong> sentences handed down tohigh-pr<strong>of</strong>ile activists such as Liu Xiaobo, Tan Zuoren and Huang Qi made headl<strong>in</strong>esaround <strong>the</strong> world, <strong>the</strong> lesser-known activists who were sent to black jails, RTL, andimpris<strong>on</strong>ed round out <strong>the</strong> larger and more complex story <strong>of</strong> an envir<strong>on</strong>ment which wasmore hostile towards human rights defenders than <strong>in</strong> previous years. Because <strong>of</strong> <strong>the</strong>government’s ever-shift<strong>in</strong>g, <strong>in</strong>visible l<strong>in</strong>e demarcat<strong>in</strong>g acceptable and unacceptable rightsdefense activities, no human rights defender <strong>in</strong> Ch<strong>in</strong>a is immune from harassment orretaliati<strong>on</strong>, and those who were s<strong>in</strong>gled out and targeted by <strong>the</strong> government <strong>in</strong> 2009 <strong>of</strong>tenfound <strong>the</strong>mselves fac<strong>in</strong>g more serious c<strong>on</strong>sequences than <strong>the</strong>y might have <strong>in</strong> <strong>the</strong> recentpast.Despite Ch<strong>in</strong>ese <strong>of</strong>ficials’ relentless efforts to stifle human rights activism, <strong>the</strong>y havebeen unable to stop human rights defenders from spread<strong>in</strong>g awareness <strong>of</strong> <strong>the</strong> multitude <strong>of</strong>rights abuses tak<strong>in</strong>g place <strong>in</strong> c<strong>on</strong>temporary Ch<strong>in</strong>a. As more and more ord<strong>in</strong>ary citizensbecome aware <strong>of</strong> <strong>the</strong> negative aspects <strong>of</strong> <strong>the</strong> current system—<strong>the</strong> lack <strong>of</strong> <strong>the</strong> rule <strong>of</strong> law,freedom <strong>of</strong> expressi<strong>on</strong>, and freedom <strong>of</strong> associati<strong>on</strong>, to name just a few—<strong>the</strong>y beg<strong>in</strong> totake acti<strong>on</strong>s to promote and defend human rights <strong>the</strong>mselves. This is especially true forthose citizens who pers<strong>on</strong>ally experienced <strong>in</strong>justice, and <strong>in</strong> <strong>the</strong> process <strong>of</strong> seek<strong>in</strong>gaccountability and redress discover that <strong>the</strong>y are not al<strong>on</strong>e—that <strong>the</strong>ir plight is <strong>the</strong> result<strong>of</strong> government policies and practices, and is <strong>on</strong>e shared by countless o<strong>the</strong>rs. The desirefor better protecti<strong>on</strong> <strong>of</strong> human rights has l<strong>on</strong>g s<strong>in</strong>ce g<strong>on</strong>e bey<strong>on</strong>d a limited circle <strong>of</strong>veteran dissidents and activists, and is now held by many ord<strong>in</strong>ary Ch<strong>in</strong>ese citizens whowill be <strong>the</strong> agents <strong>of</strong> change for <strong>the</strong> future.47
