<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010corrupti<strong>on</strong> raised by villagers. Despite <strong>the</strong>se pr<strong>on</strong>ouncements, however, CHRD receiveda number <strong>of</strong> reports accus<strong>in</strong>g local governments <strong>of</strong> manipulat<strong>in</strong>g electi<strong>on</strong> procedures andbrib<strong>in</strong>g and <strong>in</strong>timidat<strong>in</strong>g villagers with impunity, effectively depriv<strong>in</strong>g eligible voters <strong>of</strong><strong>the</strong>ir right to vote <strong>in</strong> village electi<strong>on</strong>s. For example:• On May 26, <strong>the</strong> authorities <strong>in</strong> Penglu Village, Qianjiang City, Hubei Prov<strong>in</strong>ce,reportedly failed to follow proper procedures dur<strong>in</strong>g village electi<strong>on</strong>s. Instead <strong>of</strong>vot<strong>in</strong>g at a designated locati<strong>on</strong> at a designated time, voters were asked to vote at<strong>the</strong>ir homes, and some were given bribes and o<strong>the</strong>rs were <strong>in</strong>timidated <strong>in</strong>to vot<strong>in</strong>gfor a certa<strong>in</strong> candidate. More than ten villagers were unable to vote because <strong>the</strong>authorities “ran out <strong>of</strong> ballots.” This electi<strong>on</strong> was a redo <strong>of</strong> a previous electi<strong>on</strong>held <strong>on</strong> November 20, 2008, <strong>the</strong> result <strong>of</strong> which was nullified due to seriousviolati<strong>on</strong>s <strong>of</strong> electi<strong>on</strong> procedures. 89• On May 29, <strong>in</strong> an electi<strong>on</strong> <strong>in</strong> Xiaochen Village, Ruzhou City, Henan Prov<strong>in</strong>ce, alocal tyrant named Chen Shouxu ( ) was chosen as <strong>the</strong> village head. Chen’sbro<strong>the</strong>r, a high-rank<strong>in</strong>g police <strong>of</strong>ficer <strong>in</strong> Ruzhou City, reportedly threatenedvillagers that <strong>the</strong>y would face “serious c<strong>on</strong>sequences” if <strong>the</strong>y did not vote forChen. Follow<strong>in</strong>g Chen Shouxu’s electi<strong>on</strong>, he sought out Yang Qi ( a 46-year-old villager whom Chen believed had not voted for him. When Yang said hewould report his vote-rigg<strong>in</strong>g to higher authorities, Chen Shouxu called hisbro<strong>the</strong>r, who tied Yang up and beat him repeatedly with three o<strong>the</strong>r policemenfrom <strong>the</strong> Ruzhou City PSB. Yang suffered multiple <strong>in</strong>ternal <strong>in</strong>juries and afterhav<strong>in</strong>g to pay for medical treatment, he <strong>in</strong>curred a large debt and is now destitute.Yang and his family have compla<strong>in</strong>ed to <strong>the</strong> Ruzhou City PSB, but reportedly noacti<strong>on</strong> has been taken aga<strong>in</strong>st <strong>the</strong> alleged torturers. 90杨 续 守 陈奇 ),CHRD also received reports <strong>of</strong> villagers and activists threatened for m<strong>on</strong>itor<strong>in</strong>g electi<strong>on</strong>s.For example, <strong>on</strong> March 11, a group <strong>of</strong> villagers from Yuekou Town, Tianmen City,Hubei Prov<strong>in</strong>ce submitted a letter to various local government agencies alleg<strong>in</strong>g that <strong>the</strong>current local People’s C<strong>on</strong>gress representative was not elected accord<strong>in</strong>g to legalprocedures. On March 14, a group <strong>of</strong> policemen from Yuekou Town Nati<strong>on</strong>al SecurityUnit threatened <strong>the</strong> villagers regard<strong>in</strong>g <strong>the</strong> letter. Hav<strong>in</strong>g still not received a resp<strong>on</strong>se,villagers went to several different government <strong>of</strong>fices <strong>in</strong> Tianmen City <strong>on</strong> April 27. Theywere sent back and forth between <strong>of</strong>ficials <strong>in</strong> different departments, who warned <strong>the</strong>mthat <strong>the</strong>y would be punished for publish<strong>in</strong>g <strong>the</strong>ir compla<strong>in</strong>ts <strong>on</strong> websites based overseas. 91For those <strong>in</strong>dividuals who may have been elected as village heads accord<strong>in</strong>g to properprocedures, it is unclear to what extent <strong>the</strong>y enjoy any <strong>in</strong>dependent power over villageaffairs. The seizure and forcible demoliti<strong>on</strong> <strong>of</strong> build<strong>in</strong>gs bel<strong>on</strong>g<strong>in</strong>g to Baihutou Village <strong>in</strong>Guangxi Prov<strong>in</strong>ce was a strik<strong>in</strong>g example <strong>of</strong> how, despite <strong>the</strong> promise <strong>of</strong> “democraticmanagement by villagers,” villagers’ wishes were overridden by those <strong>of</strong> unelected<strong>of</strong>ficials higher up <strong>in</strong> <strong>the</strong> hierarchy. Baihutou Village is a part <strong>of</strong> Y<strong>in</strong>tan Town, which is<strong>in</strong> turn a part <strong>of</strong> Beihai City, Guangxi Prov<strong>in</strong>ce. In April 2009, <strong>the</strong> village committee sealwas seized from <strong>the</strong> elected village chief, Xu Kun ( by <strong>of</strong>ficials from Y<strong>in</strong>tan Town.Without Xu’s or <strong>the</strong> villagers’ knowledge, <strong>the</strong> seal was <strong>the</strong>n used to authorize a c<strong>on</strong>tractthat permitted <strong>the</strong> forcible demoliti<strong>on</strong> <strong>of</strong> several build<strong>in</strong>gs bel<strong>on</strong>g<strong>in</strong>g to <strong>the</strong> village and许23坤 ),
