<str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Situati<strong>on</strong> <strong>of</strong> <strong>Human</strong> <strong>Rights</strong> <strong>Defenders</strong> <strong>in</strong> Ch<strong>in</strong>a (2009)April 26, 2010The Ch<strong>in</strong>ese government has l<strong>on</strong>g threatened <strong>the</strong> jobs <strong>of</strong> human right defenders whom<strong>the</strong>y seek to keep <strong>in</strong> l<strong>in</strong>e. Because many pr<strong>of</strong>essi<strong>on</strong>als—<strong>in</strong>clud<strong>in</strong>g journalists, pr<strong>of</strong>essors,and lawyers—still require <strong>of</strong>ficial licenses or permits to hold <strong>the</strong>ir positi<strong>on</strong>s, government<strong>of</strong>ficials are able to exert significant pressure <strong>on</strong> employers to threaten human rightsdefenders whose livelihood depends <strong>on</strong> this <strong>of</strong>ficial approval. For example,• Wang Q<strong>in</strong>gy<strong>in</strong>g ( ), a pr<strong>of</strong>essor <strong>of</strong> ec<strong>on</strong>omics at Guangd<strong>on</strong>g University <strong>of</strong>Technology’s Huali College, was forced to resign from his teach<strong>in</strong>g post <strong>on</strong>December 8 under pressure from school authorities. Wang, a Charter 08 signatory,had jo<strong>in</strong>ed fellow dissidents <strong>in</strong> an out<strong>in</strong>g to Guangzhou's Baiyun Mounta<strong>in</strong> dur<strong>in</strong>gwhich <strong>the</strong>y wore t-shirts bear<strong>in</strong>g <strong>the</strong> slogan “One Party Dictatorship is aDisaster.” 138营 清 王What was unique <strong>in</strong> 2009, however, was <strong>the</strong> government’s use <strong>of</strong> this tactic <strong>on</strong> a largerscale to punish lawyers <strong>in</strong> Beij<strong>in</strong>g who were defend<strong>in</strong>g human rights and advocat<strong>in</strong>g for amore democratic and aut<strong>on</strong>omous Beij<strong>in</strong>g Lawyers Associati<strong>on</strong>. In May, Beij<strong>in</strong>g <strong>of</strong>ficialspressured law firms to “fail” at least twenty human rights lawyers <strong>in</strong> <strong>the</strong>ir annualperformance evaluati<strong>on</strong>s and <strong>in</strong> February, Beij<strong>in</strong>g’s Yit<strong>on</strong>g Law Firm was ordered toclose for six m<strong>on</strong>ths for “re-organizati<strong>on</strong>” after some <strong>of</strong> its lawyers became <strong>in</strong>volved <strong>in</strong>advocat<strong>in</strong>g for direct electi<strong>on</strong>s <strong>of</strong> <strong>the</strong> leadership <strong>of</strong> <strong>the</strong> Beij<strong>in</strong>g Lawyers Associati<strong>on</strong>. Restricti<strong>on</strong> <strong>of</strong> movement: “s<strong>of</strong>t detenti<strong>on</strong>” and “forced travel”Although police subject human rights defenders to unlawful “s<strong>of</strong>t detenti<strong>on</strong>” and “forcedtravel” throughout <strong>the</strong> year, <strong>the</strong>se restricti<strong>on</strong>s <strong>on</strong> pers<strong>on</strong>al liberty are most frequentlyimposed <strong>on</strong> human rights defenders dur<strong>in</strong>g “sensitive” periods or events, such as <strong>the</strong>annual Two Meet<strong>in</strong>gs <strong>in</strong> March, visits by foreign <strong>of</strong>ficials, and <strong>the</strong> anniversary <strong>of</strong> <strong>the</strong>Tiananmen Square Massacre <strong>on</strong> June 4, dur<strong>in</strong>g which <strong>the</strong> government has a particular<strong>in</strong>terest <strong>in</strong> prevent<strong>in</strong>g people from speak<strong>in</strong>g out about rights abuses. CHRD believes <strong>the</strong>number <strong>of</strong> human rights defenders subjected to “s<strong>of</strong>t detenti<strong>on</strong>” and “forced travel”dur<strong>in</strong>g 2009 was higher than <strong>in</strong> years past, thanks largely to <strong>the</strong> number <strong>of</strong> sensitiveevents which took place dur<strong>in</strong>g <strong>the</strong> year. “Forced travel” and “s<strong>of</strong>t detenti<strong>on</strong>” are equallyunlawful, hav<strong>in</strong>g absolutely no basis <strong>in</strong> Ch<strong>in</strong>ese law.The two types <strong>of</strong> restricti<strong>on</strong>s are similar <strong>in</strong> objective, but differ slightly <strong>in</strong> executi<strong>on</strong>.Individuals subjected to “s<strong>of</strong>t detenti<strong>on</strong>” are guarded by police stati<strong>on</strong>ed outside <strong>the</strong>irhomes. Though some <strong>in</strong>dividuals may be allowed to leave <strong>the</strong>ir homes dur<strong>in</strong>g “s<strong>of</strong>tdetenti<strong>on</strong>,” <strong>the</strong>y are closely followed and m<strong>on</strong>itored by police or required to travel <strong>in</strong>police vehicles, and <strong>of</strong>ten <strong>the</strong>y are barred from meet<strong>in</strong>g o<strong>the</strong>r “sensitive” <strong>in</strong>dividuals.O<strong>the</strong>rs are not allowed to leave <strong>the</strong>ir homes at any po<strong>in</strong>t dur<strong>in</strong>g <strong>the</strong> “s<strong>of</strong>t detenti<strong>on</strong>.”“Forced travel” refers to a mandatory trip ordered by <strong>the</strong> police or government <strong>of</strong>ficialstaken outside <strong>of</strong> <strong>on</strong>e’s city <strong>of</strong> residence with a police escort. Sometimes <strong>the</strong>se trips spanas l<strong>on</strong>g as <strong>on</strong>e m<strong>on</strong>th and cover wide swaths <strong>of</strong> <strong>the</strong> country; o<strong>the</strong>r times <strong>the</strong>y may <strong>on</strong>ly<strong>in</strong>volve spend<strong>in</strong>g a few days <strong>in</strong> a nearby town.38
