<strong>Municipal</strong> <strong>Study</strong> <strong>2011</strong>Building Permit FeesBill 124, the Building Code Statute Amendment Act, 2002 was given Royal assent on June 27, 2002and subsequently amended the Building Code Act, 1992 as it relates to imposing fees. As such,municipalities across Ontario review and update their fees to ensure compliance with the Act. Withrespect to establishing fees under the Building Code Act, Section 7 <strong>of</strong> the Act provides municipalitieswith general powers to impose fees through passage <strong>of</strong> a by-law. The Council <strong>of</strong> a municipality maypass by-laws:Requiring the payment <strong>of</strong> fees on applications for issuance <strong>of</strong> permits and for prescribing theamounts there<strong>of</strong>Providing for refunds <strong>of</strong> fees under such circumstances as are prescribedThe Building Code Statute Law Amendment Act, 2002 imposed additional requirements onmunicipalities in establishing fees under the Act, in that “The total amount <strong>of</strong> the fees authorized underclause (1)(c) must not exceed the anticipated reasonable cost <strong>of</strong> the principal authority to administerand enforce this Act in its area <strong>of</strong> jurisdiction.”In addition, the amendments also require municipalities to:Reduce fees to reflect the portion <strong>of</strong> service performed by a Registered Code AgencyPrepare and make available to the public annual reports with respect to the fees imposed under theAct and associated costs; andUndertake a public process, including notice and public meeting requirements, when a change inthe fees is proposed.O. Reg. 305/03 is the associated regulation arising from the Building Code Statute Law AmendmentAct, 2002. The regulation provides details on the contents <strong>of</strong> the annual report and the publicrequirements for the imposition or change in fees. Section 11.2 <strong>of</strong> Bill 124 restricts the use <strong>of</strong> buildingpermit revenues to recover only the “reasonable anticipated costs” <strong>of</strong> activities mandated by theBuilding Code Act.User Fees & Revenue Information168
