10. Have you ascertained all dangerous places from caving in <strong>of</strong> mines and<br />

fenced <strong>the</strong> f;ame securely ?<br />

11. Do you fully understand <strong>the</strong> meaning <strong>of</strong> <strong>the</strong> Mining Act <strong>of</strong> 1870, and<br />

<strong>the</strong> penalties it imposes for neglect or failures to comply ; and fur<strong>the</strong>r<br />

<strong>the</strong> right <strong>of</strong> action by <strong>the</strong> heirs <strong>of</strong> any person that may lose <strong>the</strong>ir lives<br />

<strong>the</strong>reby as provided by law ?<br />

12. Have you prescribed your own rules and regulations for th^ government<br />

<strong>of</strong> your mines, and posted <strong>the</strong> same rules and regulations in<br />

conspicuous places in and about <strong>the</strong> colliery, that all your men may<br />

fully understand your instructions and mode <strong>of</strong> government <strong>of</strong> <strong>the</strong><br />

same and carry <strong>the</strong> same into effect ; or do you permit unskillful persons<br />

to work where gases are evolved, where, by <strong>the</strong>ir ignorant acts,<br />

<strong>the</strong>y may endanger <strong>the</strong> lives <strong>of</strong> your men and property ?<br />

13. Have you employed or entrusted any persons, o<strong>the</strong>r than intelligent<br />

and practical persons, to do duty as top and bottom men in your slope<br />

or shaft, and whom you know will take an interest in doing justice to<br />

your property and <strong>the</strong> safety <strong>of</strong> men, and enforce <strong>the</strong> rules and duties<br />

prescribed for <strong>the</strong>m ?<br />

IJ. Have you discharged reckless or incompetent persons from responsible<br />

stations, knowing <strong>the</strong>m to be such, and again restored <strong>the</strong>m to places<br />

where <strong>the</strong>ir acts may endanger <strong>the</strong> safety <strong>of</strong> men and property ?<br />

15. Are you satisfied that your mines are properly managed for <strong>the</strong> securitj'<br />

<strong>of</strong> your men and your own interest under <strong>the</strong> present system, or does<br />

it require some improvement and time to effect <strong>the</strong> desired and benefited<br />

mining law, passed and approved <strong>the</strong> third day <strong>of</strong> March, A. D. 1870, and<br />

especially in all things that are herein marked deficient, or consider yourself<br />

open and subject to <strong>the</strong> operations <strong>of</strong> <strong>the</strong> law itself, as approved for in many<br />

sections, but particularly in sections five and twenty-four.<br />

Sir :—In conformity with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> eighth section <strong>of</strong> <strong>the</strong> act<br />

<strong>of</strong> Assembly, entitled "An Act providing for <strong>the</strong> health and safety <strong>of</strong> persons<br />

employed in <strong>coal</strong> mines, approved <strong>the</strong> 3d day <strong>of</strong> March, A. D. 1870,"<br />

I herewith report measurements <strong>of</strong> <strong>the</strong> quantum <strong>of</strong> air supplied for ventilating<br />

each panel, district and gangway, tested weekly by instruments ;<br />

also <strong>the</strong> temperature outside and inside <strong>the</strong> mine.<br />
