The General C<strong>on</strong>ference of the Internati<strong>on</strong>al Labour Organisati<strong>on</strong>,<br />

Having been c<strong>on</strong>vened at Geneva by the Governing Body of the Internati<strong>on</strong>al Labour Office,<br />

and having met in its Sixty-first Sessi<strong>on</strong> <strong>on</strong> 2 June 1976, and<br />

Recalling the terms of existing internati<strong>on</strong>al labour C<strong>on</strong>venti<strong>on</strong>s and Recommendati<strong>on</strong>s – in<br />

particular the Freedom of Associati<strong>on</strong> and Protecti<strong>on</strong> of the Right to Organise C<strong>on</strong>venti<strong>on</strong>,<br />

1948, the Right to Organise and Collective Bargaining C<strong>on</strong>venti<strong>on</strong>, 1949, and the C<strong>on</strong>sultati<strong>on</strong><br />

(Industrial and Nati<strong>on</strong>al Levels) Recommendati<strong>on</strong>, 1960 – which affirm the right of<br />

employers and workers to establish free and independent organisati<strong>on</strong>s and call for measures<br />

to promote effective c<strong>on</strong>sultati<strong>on</strong> at the nati<strong>on</strong>al level between public authorities and<br />

employers’ and workers’ organisati<strong>on</strong>s, as well as the provisi<strong>on</strong>s of numerous internati<strong>on</strong>al<br />

labour C<strong>on</strong>venti<strong>on</strong>s and Recommendati<strong>on</strong>s which provide for the c<strong>on</strong>sultati<strong>on</strong> of employers’<br />

and workers’ organisati<strong>on</strong>s <strong>on</strong> measures to give effect thereto, and<br />

Having c<strong>on</strong>sidered the fourth item <strong>on</strong> the agenda of the sessi<strong>on</strong> which is entitled “Establishment<br />

of tripartite machinery to promote the implementati<strong>on</strong> of internati<strong>on</strong>al labour<br />

standards, and having decided up<strong>on</strong> the adopti<strong>on</strong> of certain proposals c<strong>on</strong>cerning tripartite<br />

c<strong>on</strong>sultati<strong>on</strong>s to promote the implementati<strong>on</strong> of internati<strong>on</strong>al labour standards and nati<strong>on</strong>al<br />

acti<strong>on</strong> relating to the activities of the Internati<strong>on</strong>al Labour Organisati<strong>on</strong>, and<br />

Having determined that these proposals shall take the form of a Recommendati<strong>on</strong>,<br />

adopts this twenty-first day of June of the year <strong>on</strong>e thousand nine hundred seventy-six, the<br />

following Recommendati<strong>on</strong>, which may be cited as the Tripartite C<strong>on</strong>sultati<strong>on</strong> (<strong>Activities</strong><br />

of the Internati<strong>on</strong>al Labour Organisati<strong>on</strong>) Recommendati<strong>on</strong>, 1976:<br />

1. In this Recommendati<strong>on</strong> the term “representative organisati<strong>on</strong>s” means the most representative<br />

organisati<strong>on</strong>s of employers and workers enjoying the right of freedom of associati<strong>on</strong>.<br />

2. (1) Each Member of the Internati<strong>on</strong>al Labour Organisati<strong>on</strong> should operate procedures<br />

which ensure effective c<strong>on</strong>sultati<strong>on</strong>s with respect to matters c<strong>on</strong>cerning the activities of the<br />

Internati<strong>on</strong>al Labour Organisati<strong>on</strong>, in accordance with Paragraphs 5 to 7 of this Recommendati<strong>on</strong>,<br />

between representatives of the government, of employers and of workers.<br />

(2) The nature and form of the procedures provided for in subparagraph (1) of this Paragraph<br />

should be determined in each country in accordance with nati<strong>on</strong>al practice, after c<strong>on</strong>sultati<strong>on</strong><br />

with the representative organisati<strong>on</strong>s where such procedures have not yet been established.<br />

(3) For instance, c<strong>on</strong>sultati<strong>on</strong>s may be undertaken –<br />

(a) through a committee specifically c<strong>on</strong>stituted for questi<strong>on</strong>s c<strong>on</strong>cerning the activities of the<br />

Internati<strong>on</strong>al Labour Organisati<strong>on</strong>;<br />

(b) through a body with general competence in the ec<strong>on</strong>omic, social or labour field;<br />

(c) through a number of bodies with special resp<strong>on</strong>sibility for particular subject areas; or<br />

(d) through written communicati<strong>on</strong>s, where those involved in the c<strong>on</strong>sultative procedures are<br />

agreed that such communicati<strong>on</strong>s are appropriate and sufficient.<br />

3. (1) The representatives of employers and workers for the purposes of the procedures<br />

provided for in this Recommendati<strong>on</strong> should be freely chosen by their representative<br />

organisati<strong>on</strong>s.<br />
