<strong>ILO</strong> special supervisory procedures.<br />
The employers have welcomed the new abrogati<strong>on</strong> and withdrawal procedures<br />
as important complements to the existing methods of renewing ILS. They expressed<br />
the hope that the c<strong>on</strong>stituti<strong>on</strong>al amendment regarding abrogati<strong>on</strong> will so<strong>on</strong> receive the<br />
necessary number of ratificati<strong>on</strong>s so that it can enter into force and be put in practice.<br />
From an employers’ viewpoint, it is also to be hoped that the four-fifths majority requirement<br />
for a GB decisi<strong>on</strong> to put an abrogati<strong>on</strong> or withdrawal item <strong>on</strong> the ILC<br />
agenda will not turn out to be an obstacle to the use of this procedure. It should be<br />
noted that this requirement does not exist for the inclusi<strong>on</strong> of standard-setting items <strong>on</strong><br />
the agenda of the ILC.<br />
Pending the coming into effect of the above c<strong>on</strong>stituti<strong>on</strong>al amendment regarding<br />
abrogati<strong>on</strong>, in the employers’ view, the possibilities of shelving of outdated C<strong>on</strong>venti<strong>on</strong>s<br />
should be more fully exploited. Ratificati<strong>on</strong> of shelved C<strong>on</strong>venti<strong>on</strong>s should be<br />
actively discouraged by the Office and supervisi<strong>on</strong> of such instruments should be<br />
avoided, as far as possible.<br />
Denunciati<strong>on</strong> of C<strong>on</strong>venti<strong>on</strong>s<br />
Renewal is also an issue for individual <strong>ILO</strong> member States wishing to keep up to<br />
date their obligati<strong>on</strong>s under ratified C<strong>on</strong>venti<strong>on</strong>s. Denunciati<strong>on</strong> provides an important<br />
means to terminate obligati<strong>on</strong>s under C<strong>on</strong>venti<strong>on</strong>s which, in the view of a government,<br />
are outdated or no l<strong>on</strong>ger corresp<strong>on</strong>d to the needs of the country. In legal terms, it is the<br />
actus c<strong>on</strong>trarius to the ratificati<strong>on</strong> of a C<strong>on</strong>venti<strong>on</strong>. There are two forms of denunciati<strong>on</strong>:<br />
l Denunciati<strong>on</strong>s c<strong>on</strong>nected to the ratificati<strong>on</strong> of a revising C<strong>on</strong>venti<strong>on</strong>: The standard<br />
final articles as from C<strong>on</strong>venti<strong>on</strong> No. 27 usually provide that a ratified C<strong>on</strong>venti<strong>on</strong><br />
is “automatically” denounced when a revising C<strong>on</strong>venti<strong>on</strong> (which has<br />
entered into force) is ratified. Once ratificati<strong>on</strong> of the new revising C<strong>on</strong>venti<strong>on</strong><br />
becomes effective the commitments arising from the original instrument come to<br />
an end. This is the most frequent case of denunciati<strong>on</strong>.<br />
l “Pure” denunciati<strong>on</strong>s: In the absence of a new revising C<strong>on</strong>venti<strong>on</strong>, or if there is<br />
no intenti<strong>on</strong> to ratify a revising C<strong>on</strong>venti<strong>on</strong>, there is also the possibility of a “pure”<br />
denunciati<strong>on</strong>. However, most C<strong>on</strong>venti<strong>on</strong>s c<strong>on</strong>tain a provisi<strong>on</strong> restricting such<br />
“pure” denunciati<strong>on</strong>s to intervals of <strong>on</strong>e year after periods of ten years from the<br />
C<strong>on</strong>venti<strong>on</strong>’s coming into force. A “pure” denunciati<strong>on</strong> usually takes effect <strong>on</strong>e<br />
year after its registrati<strong>on</strong> with the Director-General of the <strong>ILO</strong>.<br />
C<strong>on</strong>venti<strong>on</strong> No. 144 provides for government c<strong>on</strong>sultati<strong>on</strong>s with nati<strong>on</strong>al employers’<br />
and workers’ organizati<strong>on</strong>s <strong>on</strong> any proposal to denounce a ratified C<strong>on</strong>venti<strong>on</strong><br />
(Art. 5, Para. 1 (e); see also para. 5 (f) of Recommendati<strong>on</strong> No. 152). Such c<strong>on</strong>sultati<strong>on</strong>s<br />
are obligatory for countries having ratified C<strong>on</strong>venti<strong>on</strong> No. 144. In additi<strong>on</strong>, the<br />
<strong>ILO</strong> Governing Body has stated as a general principle that, if denunciati<strong>on</strong> is c<strong>on</strong>templated,<br />
the government should fully c<strong>on</strong>sult employers’ and workers’ organizati<strong>on</strong>s <strong>on</strong>
