EMPLOYERS’ HANDBOOK ON <strong>ILO</strong> STANDARDS-RELATED ACTIVITIES<br />
The aim of C<strong>on</strong>venti<strong>on</strong>s, as indeed that of Recommendati<strong>on</strong>s, is to ensure that the law and<br />
practice of <strong>ILO</strong> member States comply with the provisi<strong>on</strong>s c<strong>on</strong>tained in the standards. The<br />
advantage that C<strong>on</strong>venti<strong>on</strong>s have over Recommendati<strong>on</strong>s is obviously that they express the<br />
desired progress in terms of legally binding obligati<strong>on</strong>s. This has two c<strong>on</strong>sequences:<br />
l it makes the whole procedure relatively irreversible by the “blocking mechanism” provided<br />
by c<strong>on</strong>diti<strong>on</strong>s for denunciati<strong>on</strong>;<br />
l it c<strong>on</strong>tributes at the same time towards a levelling of the c<strong>on</strong>diti<strong>on</strong>s for internati<strong>on</strong>al competiti<strong>on</strong>,<br />
as provisi<strong>on</strong>s of C<strong>on</strong>venti<strong>on</strong>s are recognized as being true internati<strong>on</strong>al obligati<strong>on</strong>s.<br />

The argument that a C<strong>on</strong>venti<strong>on</strong> can have an influence <strong>on</strong> the practice of States even if it<br />
has not been ratified is therefore irrelevant because, by definiti<strong>on</strong>, this is the role of a Recommendati<strong>on</strong>.<br />
Furthermore, if it is not ratified, a C<strong>on</strong>venti<strong>on</strong> is neither subject to the “blocking<br />
mechanism” nor able to c<strong>on</strong>tribute to the levelling of c<strong>on</strong>diti<strong>on</strong>s for competiti<strong>on</strong>. This distorted<br />
view with respect to the influence and prestige of C<strong>on</strong>venti<strong>on</strong>s can be in part accounted for and<br />
excused by aberrati<strong>on</strong> in a practice which, by overlooking the required follow-up, has obscured<br />
the fact that Recommendati<strong>on</strong>s are instruments in their own right. Like C<strong>on</strong>venti<strong>on</strong>s, they are<br />
supposed to be followed up to measure their impact; and to be updated to retain their relevance.<br />
And now we come to the crux of the problem: if Recommendati<strong>on</strong>s are to regain their rightful<br />
place, they should <strong>on</strong>ce again become aut<strong>on</strong>omous instruments un<strong>related</strong> to a C<strong>on</strong>venti<strong>on</strong>; they<br />
should then, and this of paramount importance, be followed up <strong>on</strong> a regular basis as provided<br />
for by the C<strong>on</strong>stituti<strong>on</strong>, to verify both their applicati<strong>on</strong> and their relevance. Only those which<br />
meet with present-day needs should be retained. I shall now turn to each of these points.<br />
1. Restoring the aut<strong>on</strong>omous nature of Recommendati<strong>on</strong>s<br />
Even a cursory reading of the compendium of C<strong>on</strong>venti<strong>on</strong>s and Recommendati<strong>on</strong>s is<br />
enough to see that Recommendati<strong>on</strong>s do not enjoy much prestige. As already pointed out, most<br />
of them are not aut<strong>on</strong>omous. What is more, they often merely reiterate certain provisi<strong>on</strong>s of the<br />
C<strong>on</strong>venti<strong>on</strong>, adding details which cannot be c<strong>on</strong>tained in a C<strong>on</strong>venti<strong>on</strong> or which have been<br />
rejected by the technical committee during discussi<strong>on</strong>s <strong>on</strong> the draft C<strong>on</strong>venti<strong>on</strong>. Some of their<br />
provisi<strong>on</strong>s may at times more resemble resoluti<strong>on</strong>s rather than texts to serve as a guide and<br />
model for the <strong>ILO</strong> c<strong>on</strong>stituents’ future acti<strong>on</strong>.<br />
The few aut<strong>on</strong>omous Recommendati<strong>on</strong>s are often obsolete or have been l<strong>on</strong>g forgotten.<br />
However, they still involve the <strong>ILO</strong>’s legal and moral credibility. It could even be argued that<br />
their obsolescence might affect the Organizati<strong>on</strong>’s credibility even more than in the case of<br />
C<strong>on</strong>venti<strong>on</strong>s (which are indirectly shelved when they fail to enter into effect or, depending up<strong>on</strong><br />
the case, are denounced). Fortunately, the work carried out and the proposals for reform put<br />
forward by the Working Party <strong>on</strong> Policy Regarding the Revisi<strong>on</strong> of <strong>Standards</strong>, as approved by<br />
the Governing Body, provide a very clear way out of this situati<strong>on</strong>. During the discussi<strong>on</strong>s of<br />
this group, it was acknowledged that although the abrogati<strong>on</strong> of internati<strong>on</strong>al labour C<strong>on</strong>venti<strong>on</strong>s<br />
required an amendment to the C<strong>on</strong>stituti<strong>on</strong> — which is now before this C<strong>on</strong>ference for<br />
examinati<strong>on</strong> — nothing prevented the C<strong>on</strong>ference from withdrawing any Recommendati<strong>on</strong><br />
c<strong>on</strong>sidered as obsolete by means of an acte c<strong>on</strong>traire (i.e. an instrument to undo what it has<br />
d<strong>on</strong>e), adopted in accordance with the same procedures and majority requirements as those that<br />
applied to the Recommendati<strong>on</strong> in questi<strong>on</strong>. 34 This opens up a whole new area of activity before<br />
us, as we do not have to wait for the entry into effect of this c<strong>on</strong>stituti<strong>on</strong>al amendment.<br />
2. Restoring a procedure of regular follow-up for Recommendati<strong>on</strong>s<br />
The sec<strong>on</strong>d c<strong>on</strong>diti<strong>on</strong> for restoring the status of Recommendati<strong>on</strong>s c<strong>on</strong>cerns their impact<br />
and follow-up. This is easy to fulfil, at least in theory, since it merely requires more effective
