I. Introducti<strong>on</strong><br />
Internati<strong>on</strong>al Labour <strong>Standards</strong> (ILS):<br />
The core of <strong>ILO</strong> standards-<strong>related</strong> activities<br />
<strong>ILO</strong> standards-<strong>related</strong> activities include Internati<strong>on</strong>al Labour <strong>Standards</strong> (ILS),<br />
codes of practice, technical guidelines, resoluti<strong>on</strong>s, c<strong>on</strong>clusi<strong>on</strong>s and declarati<strong>on</strong>s.<br />
These various instruments all serve a particular purpose, and they differ accordingly in<br />
their subject matter, detail of regulati<strong>on</strong>, degree of commitment, form of adopti<strong>on</strong> and<br />
follow-up. The present publicati<strong>on</strong> deals mainly with ILS which, for the time being,<br />
form the core of <strong>ILO</strong> standards-<strong>related</strong> activities. The other instruments are discussed<br />
in Chapter VII, in particular.<br />
Broadly speaking, ILS are legal instruments which embody internati<strong>on</strong>al rules <strong>on</strong><br />
social and working c<strong>on</strong>diti<strong>on</strong>s. They take the form of Internati<strong>on</strong>al Labour C<strong>on</strong>venti<strong>on</strong>s<br />
and Internati<strong>on</strong>al Labour Recommendati<strong>on</strong>s. There is an important legal difference<br />
between the two:<br />
l C<strong>on</strong>venti<strong>on</strong>s (and protocols to them), when ratified by <strong>ILO</strong> member States, create<br />
binding legal obligati<strong>on</strong>s to give effect to their provisi<strong>on</strong>s in nati<strong>on</strong>al policy, legislati<strong>on</strong><br />
and practice.<br />
l Recommendati<strong>on</strong>s are not open to ratificati<strong>on</strong>, simply providing guidance for nati<strong>on</strong>al<br />
policy, legislati<strong>on</strong> and practice. They are self-c<strong>on</strong>tained instruments, although<br />
in the past, often at the same time, a C<strong>on</strong>venti<strong>on</strong> and a more descriptive<br />
Recommendati<strong>on</strong> <strong>on</strong> the same issue have been adopted.<br />
Typically, an <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong> is built up in the following way:<br />
l Title, including the number of the C<strong>on</strong>venti<strong>on</strong> and the year of adopti<strong>on</strong>;<br />
l Preamble, giving reas<strong>on</strong>s for its adopti<strong>on</strong> and menti<strong>on</strong>ing <strong>related</strong> instruments;<br />
l Provisi<strong>on</strong>s setting out, in general terms, the main obligati<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong>;<br />
l Provisi<strong>on</strong>s dealing with definiti<strong>on</strong>s, scope of the instrument, and exempti<strong>on</strong>s;<br />
l Provisi<strong>on</strong>s setting out the C<strong>on</strong>venti<strong>on</strong>’s principles and minimum standards;<br />
l Provisi<strong>on</strong>s describing measures/methods of implementati<strong>on</strong>;<br />
l Standardized final articles dealing with procedural questi<strong>on</strong>s, such as entry into<br />
force, ratificati<strong>on</strong> and denunciati<strong>on</strong> of the C<strong>on</strong>venti<strong>on</strong>.<br />
The competent body within the <strong>ILO</strong> for the elaborati<strong>on</strong> and adopti<strong>on</strong> of ILS is the<br />
Internati<strong>on</strong>al Labour C<strong>on</strong>ference (ILC) in which each member State is represented by<br />
two government delegates, <strong>on</strong>e employers’ delegate and <strong>on</strong>e workers’ delegate. ILS<br />
require a two-thirds majority of the ILC for their adopti<strong>on</strong>.<br />
