should be <strong>on</strong> a global or regi<strong>on</strong>al basis. Pre-discussi<strong>on</strong>s could also crystallise agreement <strong>on</strong><br />
core fundamentals that would be essential for an intended standard; and they could pave<br />
the way for a better understanding during the tripartite debate <strong>on</strong> a given standard-setting<br />
issue at the annual C<strong>on</strong>ference.<br />
12. If, following a pre-discussi<strong>on</strong>, the C<strong>on</strong>ference believes that an item is of interest, it should<br />
adopt a Resoluti<strong>on</strong> recommending the item to the Governing Body for possible inclusi<strong>on</strong><br />
in a future C<strong>on</strong>ference agenda. By starting with a pre-discussi<strong>on</strong>, items that are not ripe for<br />
standard setting will not advance in the process. If the issue of c<strong>on</strong>tract labour had been<br />
addressed in a C<strong>on</strong>ference pre-discussi<strong>on</strong> (much wider than the meeting of experts which<br />
was held) the loss of more than two years of Office and C<strong>on</strong>ference time and credibility<br />
would have been avoided The forthcoming General Discussi<strong>on</strong> in 2001 <strong>on</strong> the difficult<br />
issue <strong>on</strong> social protecti<strong>on</strong> will provide, we hope, a good example of the usefulness of prediscussi<strong>on</strong>s.<br />
13. Shortlisting of items in the Portfolio should reflect better the wishes of the Governing<br />
Body rather than the state of preparati<strong>on</strong> of a particular issue within the Office. Before any<br />
pre-discussi<strong>on</strong>s take place, the existing Governing Body committees could also provide an<br />
advisory role to the Office and Governing Body in discussing issues for standard setting as<br />
standard setting should not take place in a policy vacuum. The Governing Body discussi<strong>on</strong><br />
<strong>on</strong> a potential standard should be near the end, not the beginning, of the process.<br />
14. <strong>ILO</strong> questi<strong>on</strong>naires need to be more than a collecti<strong>on</strong> of affirmative and negative resp<strong>on</strong>ses<br />
to the questi<strong>on</strong>s posed. The Office needs to take into account the detailed resp<strong>on</strong>ses to the<br />
questi<strong>on</strong>s and tailor the draft proposal for a standard to fit resp<strong>on</strong>ses received. The questi<strong>on</strong>naires<br />
should deal with broad policies and principles and avoid micromanaging the<br />
issue in the nati<strong>on</strong>al c<strong>on</strong>text. The Office could use two types of questi<strong>on</strong>naires: a general,<br />
broad questi<strong>on</strong>naire to be used before the pre-discussi<strong>on</strong> and a questi<strong>on</strong>naire tailored to the<br />
c<strong>on</strong>clusi<strong>on</strong>s of the C<strong>on</strong>ference pre- discussi<strong>on</strong>. A number of the <strong>ILO</strong>’s c<strong>on</strong>stituents go to<br />
c<strong>on</strong>siderable trouble to resp<strong>on</strong>d to questi<strong>on</strong>naires, but by no means enough. This sometimes<br />
leads to an imbalance in the interpretati<strong>on</strong>s of the resp<strong>on</strong>ses received. Ways should<br />
be explored to balance the need for better-quality representative informati<strong>on</strong> from c<strong>on</strong>stituents<br />
to be at the disposal of the Office, with the reality that for many organisati<strong>on</strong>s,<br />
resp<strong>on</strong>ding to <strong>ILO</strong> questi<strong>on</strong>naires represents a real administrative and technical burden.<br />
Questi<strong>on</strong>naires should be cleared through the Governing Body.<br />
REVISION OF STANDARDS<br />
15. In terms of the revisi<strong>on</strong> of <strong>Standards</strong>, the <strong>ILO</strong> should make further use of the General<br />
Surveys. The use of existing simplified and more targeted revisi<strong>on</strong> methods as suggested in<br />
the document submitted to the Governing Body Working Party <strong>on</strong> the Policy regarding the<br />
Revisi<strong>on</strong> of <strong>Standards</strong> (LILS/WP/PRS2, Nov 1999) seems appropriate.<br />
16. Revisi<strong>on</strong> of a standard does not necessarily mean revisi<strong>on</strong> upwards and it should be d<strong>on</strong>e<br />
with the purpose to facilitate the ratificati<strong>on</strong> and applicability of C<strong>on</strong>venti<strong>on</strong>s. As far as<br />
possible, revisi<strong>on</strong> should be combined with the c<strong>on</strong>solidati<strong>on</strong> of standards to c<strong>on</strong>tribute to<br />
the c<strong>on</strong>sistency of the <strong>ILO</strong>’s standard-setting system. The 1997 C<strong>on</strong>stituti<strong>on</strong>al amendment<br />
has yet to enter into force. This amendment would permit the withdrawal and abrogati<strong>on</strong> of<br />
instruments, subject to a two-thirds majority vote of the delegates at any given C<strong>on</strong>ference.<br />
To date, ratificati<strong>on</strong> of the amendment has been insufficient. The Office should launch a<br />
campaign for the ratificati<strong>on</strong> of this amendment. Abrogati<strong>on</strong>/withdrawal and revisi<strong>on</strong><br />
exercises should also be guided by the principle of c<strong>on</strong>tinued relevance of a particular<br />
standard.<br />
