l Competent nati<strong>on</strong>al authority: This is the body that has the power to enact legislati<strong>on</strong><br />

or to take other acti<strong>on</strong> to implement the instrument. Usually this is the parliament;<br />

however, depending <strong>on</strong> nati<strong>on</strong>al rules, it may be a different body.<br />

l Form of submissi<strong>on</strong>: The submissi<strong>on</strong> “should always be accompanied or followed<br />

by a statement or proposals setting out the government’s views as to the acti<strong>on</strong> to<br />

be taken <strong>on</strong> the instruments”, since “Article 19 of the C<strong>on</strong>stituti<strong>on</strong> is clearly aimed<br />

at obtaining a decisi<strong>on</strong> from the competent authorities”.<br />

l Extent of submissi<strong>on</strong>: It is emphasized in the Memorandum that “governments<br />

have complete freedom as to the nature of the proposals to be made” to the competent<br />

authorities and that submissi<strong>on</strong> “does not imply any obligati<strong>on</strong> to propose the<br />

ratificati<strong>on</strong> or applicati<strong>on</strong> of the instrument in questi<strong>on</strong>”. Thus, a government may,<br />

in full accordance with the above <strong>ILO</strong> c<strong>on</strong>stituti<strong>on</strong>al rules, propose that the competent<br />

authorities not ratify a C<strong>on</strong>venti<strong>on</strong> or that a decisi<strong>on</strong> in this regard be postp<strong>on</strong>ed.<br />

Employers’ and workers’ organizati<strong>on</strong>s, first of all, must be informed by their government<br />

that it has fulfilled the submissi<strong>on</strong> obligati<strong>on</strong> (Art. 23, para. 2, <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong>;<br />

for more detail see Chapter V). Over and above that, governments should c<strong>on</strong>sult<br />

representative organizati<strong>on</strong>s of employers and workers <strong>on</strong> “… the proposals to be<br />

made to the competent authority or authorities in c<strong>on</strong>necti<strong>on</strong> with the submissi<strong>on</strong> of<br />

C<strong>on</strong>venti<strong>on</strong>s and Recommendati<strong>on</strong>s …” (Art. 5, para. 1 (b) of C<strong>on</strong>venti<strong>on</strong> No. 144 and<br />

Para. 5 (b) of Recommendati<strong>on</strong> No. 152). These c<strong>on</strong>sultati<strong>on</strong>s are obligatory for countries<br />

which have ratified C<strong>on</strong>venti<strong>on</strong> No. 144.<br />

As a result of this informati<strong>on</strong>/c<strong>on</strong>sultati<strong>on</strong>, employers know whether, when and<br />

in what way the government intends to implement a new instrument. They are in a<br />

positi<strong>on</strong> to comment <strong>on</strong> the government’s plans or to present their own proposals. For<br />

example, they may specify why, in their view, the ratificati<strong>on</strong> or the intended way of<br />

implementing a particular C<strong>on</strong>venti<strong>on</strong> would or would not corresp<strong>on</strong>d to the needs of<br />

employers in the country, generally or at present.<br />

Ratificati<strong>on</strong> and implementati<strong>on</strong> of C<strong>on</strong>venti<strong>on</strong>s<br />

Under internati<strong>on</strong>al law, ratificati<strong>on</strong> of a C<strong>on</strong>venti<strong>on</strong> is the voluntary undertaking<br />

by a member State to apply the C<strong>on</strong>venti<strong>on</strong>’s provisi<strong>on</strong>s in nati<strong>on</strong>al law and practice.<br />

The main purpose of ratificati<strong>on</strong> is to promote, through internati<strong>on</strong>al legal commitments,<br />

the applicati<strong>on</strong> of labour standards in member States. In additi<strong>on</strong>, ratificati<strong>on</strong><br />

has the following significant functi<strong>on</strong>s:
