30 This procedure creates an instituti<strong>on</strong>al link between the C<strong>on</strong>ference, the body entrusted with standard<br />

setting, and nati<strong>on</strong>al parliaments, up<strong>on</strong> which the binding effect of these instruments in the countries<br />

c<strong>on</strong>cerned is c<strong>on</strong>tingent. The aim of bringing the instrument before the competent authorities is obviously to<br />

allow parliaments to pr<strong>on</strong>ounce, in full knowledge of the facts, <strong>on</strong> the follow-up to be given to the instruments<br />

adopted by the <strong>ILO</strong> and to reach a decisi<strong>on</strong>, whatever the nature of this decisi<strong>on</strong>. Supervisi<strong>on</strong> of the<br />

obligati<strong>on</strong> to submit instruments to the competent authorities has, over the years, become merely a formal<br />

exercise with very few excepti<strong>on</strong>s. This c<strong>on</strong>stituti<strong>on</strong>al obligati<strong>on</strong> should assume <strong>on</strong>ce again the character<br />

that it had at the beginning: to encourage member States to ratify or implement the instruments they have<br />

adopted; to provide assistance to parliaments; to provide for a wider distributi<strong>on</strong> of statements or proposals<br />

accompanying the submissi<strong>on</strong>, etc. This mechanism does not work for the early C<strong>on</strong>venti<strong>on</strong>s. This is <strong>on</strong>e of<br />

the reas<strong>on</strong>s why, following the Social Summit in Copenhagen, I asked those member States who had not<br />

d<strong>on</strong>e so to communicate their intenti<strong>on</strong>s to ratify the seven core C<strong>on</strong>venti<strong>on</strong>s. I do not, however, believe that<br />

this soluti<strong>on</strong> should extend to other instruments. It must remain excepti<strong>on</strong>al and be reserved for core C<strong>on</strong>venti<strong>on</strong>s;<br />

if not it will cease to be effective.<br />
