A. A MORE TARGETED CHOICE OF SUBJECTS<br />

The <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong> wisely provided, under article 14(2), that the Governing<br />

Body should undertake the necessary steps “to ensure thorough technical preparati<strong>on</strong> and<br />

adequate c<strong>on</strong>sultati<strong>on</strong> of the Members primarily c<strong>on</strong>cerned, by means of a preparatory c<strong>on</strong>ference<br />

or otherwise, prior to the adopti<strong>on</strong> of a C<strong>on</strong>venti<strong>on</strong> or Recommendati<strong>on</strong> by the<br />

C<strong>on</strong>ference”.<br />

The aim of this provisi<strong>on</strong> was that future standards should be commensurate with real<br />

needs so as to have real impact. Today, now that the <strong>ILO</strong> membership has grown so much and<br />

the Organizati<strong>on</strong> is involved in so many areas, this task is just as indispensable but has become<br />

increasingly difficult to fulfil. Recent experience has shown that the difficulties and vicissitudes<br />

inherent in the subject have not always been gauged before embarking irreversibly up<strong>on</strong> the<br />

drafting of standards. To try and overcome these difficulties and comply with the objective in<br />

the C<strong>on</strong>stituti<strong>on</strong>, we should examine three possible additi<strong>on</strong>al approaches: extending the range<br />

of choices; applying more strictly the selecti<strong>on</strong> criteria to assess better the “added value” that a<br />

new standard might bring; and adopting a more rati<strong>on</strong>al procedure.<br />

1. Extending the range of choices<br />

Under article 10 of the C<strong>on</strong>stituti<strong>on</strong>, it is the Office’s task to examine the subjects which it<br />

is proposed to bring before the C<strong>on</strong>ference with a view to the c<strong>on</strong>clusi<strong>on</strong> of internati<strong>on</strong>al instruments.<br />

18 The Office’s Report, intended to allow the Governing Body to take a decisi<strong>on</strong> <strong>on</strong> the<br />

choice of subjects, must be based <strong>on</strong> the widest possible informati<strong>on</strong> c<strong>on</strong>cerning nati<strong>on</strong>al law<br />

and practice. This informati<strong>on</strong> should also include the provisi<strong>on</strong>s adopted by regi<strong>on</strong>al instituti<strong>on</strong>s<br />

(NAFTA, MERCOSUR, European Uni<strong>on</strong>, etc.) in the areas under c<strong>on</strong>siderati<strong>on</strong>, provided<br />

that they have an impact <strong>on</strong> the law or practice of their members.<br />

At present, the studies of the Office are carried out <strong>on</strong> the basis of informati<strong>on</strong> available at<br />

headquarters. It may sometimes be necessary to call meetings of experts <strong>on</strong> the subject. For<br />

instance, the decisi<strong>on</strong> to include <strong>on</strong> the C<strong>on</strong>ference agenda the issue of the protecti<strong>on</strong> of workers<br />

in the event of their employer’s insolvency was preceded by a meeting of experts, which<br />

produced a report allowing the Governing Body to take a decisi<strong>on</strong> in full knowledge of the<br />

issues involved. In the case of child labour, the informati<strong>on</strong> c<strong>on</strong>tained in the document submitted<br />

to the Governing Body was gathered from studies and research carried out by the competent<br />
