METHODS OF RENEWING ILS<br />

Denunciati<strong>on</strong>s of <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s<br />

l By July 2001, 582 denunciati<strong>on</strong>s of <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s have been registered.<br />

l Out of the 582 denunciati<strong>on</strong>s, 102 have not been accompanied by ratificati<strong>on</strong><br />

of a revising C<strong>on</strong>venti<strong>on</strong>.<br />

l The instrument which has received the highest number (15) of denunciati<strong>on</strong>s<br />

not accompanied by ratificati<strong>on</strong> of a revising C<strong>on</strong>venti<strong>on</strong> is the Night<br />

Work (Women) C<strong>on</strong>venti<strong>on</strong> No. 89 (Revised), 1948.<br />

the problems encountered and the measures to be taken to resolve them. Employers,<br />

too, can propose the denunciati<strong>on</strong> of a ratified C<strong>on</strong>venti<strong>on</strong> to their government, if they<br />

feel that it no l<strong>on</strong>ger meets the needs of the country or of the employers in the country.<br />

Although it may be generally desirable that denunciati<strong>on</strong>s of <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s are<br />

accompanied by the ratificati<strong>on</strong> of a revising C<strong>on</strong>venti<strong>on</strong> (see box above), “pure” denunciati<strong>on</strong>s<br />

should not necessarily always be seen as negative:<br />

l There may be understandable reas<strong>on</strong>s for denunciating an outdated C<strong>on</strong>venti<strong>on</strong><br />

without ratifying the revising <strong>on</strong>e. For instance, a country may not be in a positi<strong>on</strong><br />

to implement all provisi<strong>on</strong>s of the new instrument immediately.<br />

l Where a revising C<strong>on</strong>venti<strong>on</strong> does not (yet) exist, the c<strong>on</strong>currence of “pure” denunciati<strong>on</strong>s<br />

by several countries may indicate the need to revise a C<strong>on</strong>venti<strong>on</strong> and<br />

thus help keep the body of ILS up to date and relevant. A case in point is the<br />

denunciati<strong>on</strong> by a number of governments of the Night Work (Women) C<strong>on</strong>venti<strong>on</strong><br />

(Revised) No. 89, 1948. This induced the adopti<strong>on</strong> of a Protocol in 1990,<br />

partly revising the C<strong>on</strong>venti<strong>on</strong>, as well as the adopti<strong>on</strong> of the Night Work C<strong>on</strong>venti<strong>on</strong><br />

No. 171, 1990. In order to make this “indicator” functi<strong>on</strong> even more effectively,<br />

it would be desirable to modify the existing restricti<strong>on</strong>s <strong>on</strong> denunciati<strong>on</strong>s.<br />
