III. The creati<strong>on</strong> of ILS<br />

General remarks<br />

The creati<strong>on</strong> of ILS extends over several stages, beginning with the selecti<strong>on</strong> of<br />

standard-setting items and finishing with the adopti<strong>on</strong> of a new C<strong>on</strong>venti<strong>on</strong>/Recommendati<strong>on</strong><br />

by the ILC.<br />

Employers’ and workers’ delegates participate <strong>on</strong> an equal footing with government<br />

delegates at every stage of this process.<br />

The selecti<strong>on</strong> of items for standard-setting<br />

The selecti<strong>on</strong> of items for new standards, together with the preceding preparati<strong>on</strong><br />

of respective proposals, is the first critical phase in the standard-setting process, for the<br />

following reas<strong>on</strong>s:<br />

l In the past, the selecti<strong>on</strong> of an item for standard-setting has almost always led to<br />

the later adopti<strong>on</strong> of (a) new ILS.<br />

l The preparati<strong>on</strong> of an item, preceding selecti<strong>on</strong>, gives a certain directi<strong>on</strong> to the<br />

standard-setting process, which is likely to be reflected in the final outcome.<br />

The body resp<strong>on</strong>sible for the selecti<strong>on</strong> of items for standard-setting is the <strong>ILO</strong><br />

Governing Body (GB). The GB c<strong>on</strong>siders any suggesti<strong>on</strong> made by nati<strong>on</strong>al employers’<br />

and workers’ organizati<strong>on</strong>s (art. 14, para. 1, <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong>). It is also for the GB<br />

to make rules to ensure “a thorough technical preparati<strong>on</strong> and adequate c<strong>on</strong>sultati<strong>on</strong><br />

of the Members primarily c<strong>on</strong>cerned, by means of a preparatory c<strong>on</strong>ference or otherwise<br />

…” (art. 14, para. 2, <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong>).<br />

In practice, the GB selects items from a collecti<strong>on</strong> of standard-setting items, which<br />

is regularly updated by the <strong>ILO</strong> secretariat, taking into account recent developments.<br />

In updating the collecti<strong>on</strong>, the <strong>ILO</strong> secretariat is informed by direct annual c<strong>on</strong>sultati<strong>on</strong>s,<br />

comments and proposals from employers, workers and governments. Often, proposals<br />

originate from resoluti<strong>on</strong>s or c<strong>on</strong>clusi<strong>on</strong>s adopted by the ILC or by <strong>ILO</strong><br />

sectoral, regi<strong>on</strong>al or other meetings. (See box <strong>on</strong> following page.)<br />

One cannot overemphasize the importance of a thorough preparati<strong>on</strong> of standardsetting<br />

proposals and a selecti<strong>on</strong> reflecting proper understanding and real c<strong>on</strong>sensus:<br />

these are prec<strong>on</strong>diti<strong>on</strong>s for relevant and widely accepted ILS (see Chapter IX). For this<br />

reas<strong>on</strong>, it is imperative that employers, particularly those represented in the Governing<br />
