EMPLOYERS’ HANDBOOK ON <strong>ILO</strong> STANDARDS-RELATED ACTIVITIES<br />
TC by <strong>ILO</strong> supervisory organs to governments facing problems in implementing<br />
(ratified) C<strong>on</strong>venti<strong>on</strong>s. From an employers’ point of view, it is important that <strong>ILO</strong><br />
TC offered to governments in the implementati<strong>on</strong> of ILS duly takes into account<br />
the ec<strong>on</strong>omic situati<strong>on</strong> and the needs of enterprises in the respective country. If<br />
employers’ organizati<strong>on</strong>s in member States feel that TC specific to their needs<br />
could help them play a more meaningful role in the implementati<strong>on</strong> of ILS, they<br />
should make their respective needs known to the <strong>ILO</strong>.<br />
Creati<strong>on</strong> of standards: Another dimensi<strong>on</strong> of direct support, insufficiently<br />
used so far, c<strong>on</strong>cerns the experience gained from TC in the creati<strong>on</strong> of ILS, particularly<br />
in the preparati<strong>on</strong> of items for new ILS. This experience could be especially<br />
valuable in making ILS more realistic and needs-oriented. It would give<br />
better effect to the c<strong>on</strong>stituti<strong>on</strong>al standard-setting principle of having “due regard<br />
to those countries in which climatic c<strong>on</strong>diti<strong>on</strong>s, the imperfect development of industrial<br />
organizati<strong>on</strong>, or other special circumstances make the industrial c<strong>on</strong>diti<strong>on</strong>s<br />
substantially different ...” (art. 19, para. 3, <strong>ILO</strong> C<strong>on</strong>stituti<strong>on</strong>). Therefore, it<br />
would be appropriate for the <strong>ILO</strong> to tap this experience more systematically in its<br />
preparatory work for standard-setting.<br />
l Indirect support<br />
Although direct TC support is important for better implementati<strong>on</strong> of ILS,<br />
such a limited role would not exhaust the potential of technical cooperati<strong>on</strong>. For<br />
this reas<strong>on</strong>, the ILC 1999 “C<strong>on</strong>clusi<strong>on</strong>s c<strong>on</strong>cerning the role of the <strong>ILO</strong> in technical<br />
cooperati<strong>on</strong>” rightly pointed out that TC should more generally “help create the<br />
enabling envir<strong>on</strong>ment ... for the realizati<strong>on</strong> of the values and principles of the<br />
Organizati<strong>on</strong> in terms of development, instituti<strong>on</strong>al capability, legislati<strong>on</strong> and ec<strong>on</strong>omic<br />
and social policy.”<br />
From the employers’ perspective, a particularly important aspect of this kind<br />
of TC is instituti<strong>on</strong>al support to employers’ and workers’ organizati<strong>on</strong>s. The existence<br />
of independent and well-functi<strong>on</strong>ing organizati<strong>on</strong>s of employers and workers<br />
engaging in c<strong>on</strong>structive dialogue does not <strong>on</strong>ly have favourable effects <strong>on</strong> ec<strong>on</strong>omic<br />
and social development in <strong>ILO</strong> member countries; it is also a prec<strong>on</strong>diti<strong>on</strong><br />
for the effective implementati<strong>on</strong> and supervisi<strong>on</strong> of ILS in general.<br />
ILS in support of technical cooperati<strong>on</strong><br />
Since many <strong>ILO</strong> objectives are reflected in ILS, the standards themselves can<br />
guide the planning and executi<strong>on</strong> of TC activities. This is evident if a country has<br />
ratified relevant <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s, thus dem<strong>on</strong>strating the importance it attaches to the<br />
implementati<strong>on</strong> of these instruments for its nati<strong>on</strong>al development. The same is true if<br />
the relevance or model functi<strong>on</strong> of certain ILS is expressly menti<strong>on</strong>ed in project documents<br />
for TC activities, even if the respective C<strong>on</strong>venti<strong>on</strong>s have not been ratified by the<br />
country c<strong>on</strong>cerned.<br />
Recommendati<strong>on</strong> No. 152 c<strong>on</strong>tains a particularly important guiding principle for<br />
the executi<strong>on</strong> of TC activities in that it provides for nati<strong>on</strong>al level tripartite c<strong>on</strong>sultati<strong>on</strong>s
