for innovati<strong>on</strong> from the standard-setting techniques used by other bodies.<br />

Rec<strong>on</strong>sidering the process for adopting standards<br />

The <strong>ILO</strong> could also rec<strong>on</strong>sider the process for adopting standards. At present this is highly<br />

stylized, often using procedures that are not c<strong>on</strong>ducive to compromise. In this case the Organizati<strong>on</strong><br />

could draw <strong>on</strong> its experience of designing approaches to the preventi<strong>on</strong> or resoluti<strong>on</strong> of<br />

labour disputes, using methods that resp<strong>on</strong>d to the divergent and c<strong>on</strong>vergent interests of stakeholders.<br />

The Night Work C<strong>on</strong>venti<strong>on</strong>, 1990 (No. 171), illustrated this potential, arriving at a<br />

compromise that took into account c<strong>on</strong>stituents’ c<strong>on</strong>cerns for both gender equality and worker<br />

protecti<strong>on</strong>. A similar approach could be extended to other topics that have so far defied c<strong>on</strong>sensus,<br />

such as the revisi<strong>on</strong> of <strong>ILO</strong> instruments <strong>on</strong> working time.<br />

The wider c<strong>on</strong>text of internati<strong>on</strong>al law<br />

New standards need to be c<strong>on</strong>sidered in the wider c<strong>on</strong>text of internati<strong>on</strong>al law, since many<br />

other organizati<strong>on</strong>s and internati<strong>on</strong>al c<strong>on</strong>ferences have produced treaties <strong>on</strong> <strong>related</strong> issues such<br />

as the envir<strong>on</strong>ment and human rights. The proposed new C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the worst forms of<br />

child labour, for example, has been developed in this way – taking into account not just <strong>ILO</strong><br />

C<strong>on</strong>venti<strong>on</strong>s but also other instruments. A similar approach has been taken in the report <strong>on</strong><br />

migrant workers submitted to this sessi<strong>on</strong> of the C<strong>on</strong>ference, as well as with respect to the<br />

proposed revisi<strong>on</strong> of some <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s relating to chemicals and hazardous substances.<br />

Reinvigorating promoti<strong>on</strong>al efforts<br />

Setting standards is of course <strong>on</strong>ly the start. The <strong>ILO</strong> needs to reinvigorate its promoti<strong>on</strong>al<br />

efforts to see that standards are ratified and applied. This means ensuring that C<strong>on</strong>venti<strong>on</strong>s and<br />

Recommendati<strong>on</strong>s are well understood, by producing clear and effective publicati<strong>on</strong>s and by<br />

reaching out bey<strong>on</strong>d labour ministries, employers’ organizati<strong>on</strong>s and trade uni<strong>on</strong>s to other<br />

groups, including parliamentarians, law reform commissi<strong>on</strong>s, judges, business leaders, NGOs,<br />

women’s groups, students, academics and the unemployed. It is especially important that governments<br />

understand that <strong>ILO</strong> C<strong>on</strong>venti<strong>on</strong>s have built-in mechanisms for flexibility – a potential<br />

that few of them explore.<br />

C<strong>on</strong>centrating attenti<strong>on</strong> <strong>on</strong> high-impact standards<br />

One major problem for ratificati<strong>on</strong> is that parliaments all over the world often have a l<strong>on</strong>g<br />

list of items awaiting attenti<strong>on</strong> – not just <strong>ILO</strong> standards but also many other bilateral and multilateral<br />

instruments. In this competitive envir<strong>on</strong>ment it is important that the <strong>ILO</strong> c<strong>on</strong>centrate its<br />

attenti<strong>on</strong> <strong>on</strong> high-impact standards to make them stand out from the pack. The Declarati<strong>on</strong> <strong>on</strong><br />

Fundamental Principles and Rights at Work and its Follow-up has performed an important role<br />

here by highlighting core labour standards. The Governing Body has further identified as priorities<br />

a handful of instituti<strong>on</strong>al standards, including those <strong>on</strong> tripartite c<strong>on</strong>sultati<strong>on</strong>, <strong>on</strong> labour<br />

inspecti<strong>on</strong> and <strong>on</strong> employment policy. The social partners may wish to single out others for<br />

special attenti<strong>on</strong>, and the InFocus programmes may also be of assistance.<br />

Assisting governments to implement C<strong>on</strong>venti<strong>on</strong>s<br />

The <strong>ILO</strong> needs to be more proactive when it comes to implementati<strong>on</strong>, assisting governments<br />

in giving effect to the C<strong>on</strong>venti<strong>on</strong>s they have chosen to ratify. At the formal level this<br />

could mean helping governments revise their labour legislati<strong>on</strong> and improve their<br />
