EMPLOYERS’ HANDBOOK ON <strong>ILO</strong> STANDARDS-RELATED ACTIVITIES<br />

This provisi<strong>on</strong> implies the following opti<strong>on</strong>s/scenarios:<br />

l A member State intends to ratify a C<strong>on</strong>venti<strong>on</strong> after it has brought nati<strong>on</strong>al law<br />

and practice into line with the provisi<strong>on</strong>s of the C<strong>on</strong>venti<strong>on</strong>. This is often a gradual<br />

process leading to ratificati<strong>on</strong> <strong>on</strong>ly after a (l<strong>on</strong>ger) period of time, particularly<br />

when the adaptati<strong>on</strong>s to be made involve a rise of labour standards which depend<br />

<strong>on</strong> higher productivity levels.<br />

l A member State sees ratificati<strong>on</strong> of a C<strong>on</strong>venti<strong>on</strong> as generally inappropriate. This<br />

does not necessarily mean that the Member disagrees with the main objectives of<br />

the C<strong>on</strong>venti<strong>on</strong>. Minor disparities or peculiarities in domestic law and practice,<br />

such as the distributi<strong>on</strong> of legislative competence in Federal States, often lead to a<br />

government’s decisi<strong>on</strong> not to ratify. Law and practice may nevertheless be broadly<br />

in compliance with the substantial principles of a C<strong>on</strong>venti<strong>on</strong>.<br />

If the competent authorities do not c<strong>on</strong>sent to ratify a new C<strong>on</strong>venti<strong>on</strong>, employers’<br />

and workers’ organizati<strong>on</strong>s must be informed of this decisi<strong>on</strong> (art. 23, para. 2, <strong>ILO</strong><br />

C<strong>on</strong>stituti<strong>on</strong>, see Chapter V). In additi<strong>on</strong>, governments should c<strong>on</strong>sult employers’ and<br />

workers’ organizati<strong>on</strong>s <strong>on</strong> “the re-examinati<strong>on</strong> at appropriate intervals of unratified<br />

C<strong>on</strong>venti<strong>on</strong>s and of Recommendati<strong>on</strong>s to which effect has not yet been given, to c<strong>on</strong>sider<br />

what measures might be taken to promote their implementati<strong>on</strong> and ratificati<strong>on</strong><br />

as appropriate” (Art. 5, para. 1 (c) of C<strong>on</strong>venti<strong>on</strong> No. 144; para. 5 (d) of Recommendati<strong>on</strong><br />

No. 152). These c<strong>on</strong>sultati<strong>on</strong>s are obligatory for governments of countries having<br />

ratified C<strong>on</strong>venti<strong>on</strong> No. 144.<br />
